HomeMy WebLinkAbout17398 ORD - 12/15/19824 AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 35, OIL AND GAS WELLS, TO LIMIT THE AUTHORITY OF THE BAY DRILLING COMMITTEE TO AN ADVISORY CAPACITY; AND PROVIDING FOR SEVERANCE AND PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances of the City of Corpus Christi, Texas, Chapter 35, Oil and Gas Wells, Article III, Bay Drilling, Division 16, Permits and Inspections, be amended by amending Section 35-409 to delete the second sentence thereof in its entirety. SECTION 2. That the Code of Ordinances of the City of Corpus Christi, Texas, Chapter 35, Oil and Gas Wells, Article III, Bay Drilling, Division 16, Permits and Inspections, be amended by amending Section 35-417 in the following manners: (a) That the last sentence of the first paragraph of said section be amended by deleting the words "with the approval of the bay drilling committee." (b) That the second and third paragraphs of said section be deleted and the following paragraph inserted in their place: The permit for any nonproducing well will expire on the anniversary date next following completion of a dry hole or on the anniversary next after any well has ceased to penetrate minerals held by a valid lease to the owners of the well. Upon expiration of any well permit, the city petroleum superintendent will order that the well be abandoned and the owners will effect abandonment within one year of the order. If the owners of the well disagree with the abandonment order, they will have recourse through appeal to the city council. SECTION 3. That the Code of Ordinances of the City of Corpus Christi, Texas, Chapter 35, Oil and Gas Wells, Article IV, Gulf Drilling, Division 6, Permits and Permit Fees, be amended by amending Section 35-498 in the following manners: (a) That the last sentence of the first paragraph of said section be amended by deleting the words "with the approval of the bay drilling committee." (b) That the second and third paragraphs of said section be deleted and the following paragraph inserted in their place: 7:39R IbiltABLWIEEL tEP 2,81984 The permit for any nonproducing well will expire on the anniversary date next following completion of a dry hole or on the anniversary next after any well has ceased to penetrate minerals held by a valid lease to the owners of the well and is not within a well surface structure with other producing wells. Upon expiration of any well permit, the city petroleum superintendent will order that the well be abandoned and the location cleared of all appurtenances and the owners will effect abandonment and clear the location of all appurtenances within one year of the order. If the owners of the well disagree with the abandonment order, they will have recourse through appeal to the city council. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
