HomeMy WebLinkAbout17401 ORD - 12/15/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF DELUXE PROPERTY'S BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF SHARE 1, PARTITION OF HEARN TRACT FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Deluxe Property's for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, December 7, 1982, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described portion of Share 1, Partition of Hearn Tract, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "Al" - Apartment House District: FIELDNOTE DESCRIPTION of a 4.960 acre, more or less, tract of land out of an 11.94 acre, more or less, tract out of Share 1 (20.94 acre tract) Partition of Hearn Tract, as shown by plat recorded in Volume 5, Page 78, Miscellaneous Map Records, Nueces County, Texas. BEGINNING at a point being the intersection of the northwest right-of-way line of FM 1694, also known as Callicoate Road, and the southwest right-of-way line of Hearn Road for the east corner of said 11.94 acre tract, and the east corner of this tract; THENCE along said southwest right-of-way line of Hearn Road and along the northeast boundary line of said 11.94 acre tract, N 54° 38' 30" W, 395.37 feet to a point for a northerly corner of said 11.94 acre tract, and a northerly corner of this tract; 1 74ni OBLME �A1 1SEP 2 81984 1 THENCE S 35° 18' 10" W, 198.40 feet to interior corner of said 11.94 acre tract, corner of this tract; THENCE N 54° 38' 30" w, 223.35 feet to northerly corner of said 11.94 acre northerly corner of this tract; THENCE along the northwest boundary line of said 11.94 acre tract, S 37° 35' 00" W, 214.10 feet to a point for the west corner of this tract; a point for an and an interior a point for a tract, and a THENCE S 52° 25' 00" E, 614.45 feet to a point in said northwest right-of-way line of FM 1694 and the southeast boundary line of said 11.94 acre tract, for the south corner of this tract; THENCE along said northwest right-of-way line of FM 1694, and said southeast boundary line of 11.94 acre tract, N 36° 44' 35" E, 351.78 feet to the point of curvature of a circular curve to the right, having a central angle of 03° 07' 28", a radius of 1551.94 feet and a tangent of 42.33 feet; THENCE along the arc of said circular curve to the right, 84.63 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared suspension of the Charter rule as to consideration and voting upon or resolutions at three regular meetings so that this ordinance is requiring ordinances passed and shall take e fe t upon first reading as an emergency measure this the /,T .t.cm-A- .tc , 19O2— . day of APPROVED: % DAY OF J.
