AMENDING THE INDUSTRIAL DISTRICT AGREEMENT WITH VALERO
HYDROCARBONS COMPANY, AUTHORIZED BY ORDINANCE NO. 16351
PASSED ON JULY 1, 1981, SO AS TO ADD TO INDUSTRIAL
DISTRICT 20-A, A 23.30 ACRE TRACT OF LAND AND A 26.37
ACRE TRACT OF LAND ALL AS SET FORTH IN THE AMENDMENT TO
THE INDUSTRIAL DISTRICT AGREEMENT, A SUBSTANTIAL COPY OF
WHICH IS ATTACHED HERETO AS EXHIBIT 1; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Industrial District Agreement with Valero
Hydrocarbons Company, authorized by Ordinance No. 16351 passed on July 1,
1981, be amended so as to add to Industrial District 20-A, a 23.30 acre tract
of land and a 26.37 acre tract of land all as set forth in the amendment to
the Industrial District Agreement, a substantial copy of which is attached
hereto as Exhibit 1.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the immediate
need for efficient and effective administration of City affairs by amending
the aforementioned industrial district agreement, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the 447day of December, 1982.

This amendment to the Industrial District Agreement is entered into
by and between the City of Corpus Christi, Texas, a municipal corporation of
Nueces County, Texas, and Valero Hydrocarbons Company, a Delaware
corporation, (Landowner) and Valero Hydrocarbons Company, a Delaware
corporation, (Improvements Owner) hereinafter collectively called "COMPANY".
The City of Corpus Christi and Company agree that the attached
revision to Exhibit "A" consisting of a description of an approximately 23.30
acre tract and an approximately 26.37 acre tract acquired by Company after
January 1, 1981, shall be included within and subject to the Company's
industrial district agreement (Corpus Christi Industrial District No. 20-A
authorized by Ordinance No. 16351). Company warrants to the City that the
use of the subject tract relates directly to the primary use of the parent
tract described under the original Industrial District Agreement.

Thal we, BRYANT FICKEN, JR., WELOON L. WEBER and wife, BILLIE WEBER,
of the County of Nueces and State of Texas for and in
consideration of the sum of TEN AND NO/100 ($10.00) _DOLLARS
and other valuable consideration to the undersigned paid by the grantee herein named, the receipt of
which is hereby acknowledged,

West boundary line of said 40.00 acre tract for the NorthWest•cor-
ner of this survey from which corner a nail in flasher in said
centerline of McKinzie Road found for the Northwest corner of said
40.00 acre tract bears North 00°00150" West, 549.97 feet;
THENCE South 89°58'45" East, leaving said centerline and parallel
to the South boundary line of a 30.41 acre tradt owned'by Joe
McManus.thereof and 50.00 feet distant therefrom, measured at
right angles thereto, 1,850.51 feet for the Northeast corner of
this survey;
THENCE South 00°06'00" West 544.11 feet to a 5/8 inch iron rod
found in the centerline of a shell road for the Southeast corner
of this survey;
THENCE with the centerline of said shell road, same being the

SAVE AND EXCEPT and there is hereby reserved unto Grantors, their heirs
and assigns, all of the oil, gas and other minerals in and under and that
may be produced from the above-described property; however, Grantors, their
heirs, executors, administrators, lessees and assigns shall not have the
right of ingress or egress or the right at any time to enter upon, explore,
develop, operate or occupy the Sellers' property for the production of oil,
gas and other minerals or any of them, or for the storing, handling, trans-
porting or marketing of such oil, gas or other minerals and Sellers waive
any express or implied covenants or rights to develop the reserved mineral
estate through use of the surface estate in any manner.
This conveyance is subject to restrictions, easements and mineral re-
servations of record, which are applicable to the property herein describ-
ed, and to outstanding royalties of record..
Taxes for the current year having been prorated, the payment thereof is
hereby assumed by Grantees.

30.41 acre tract of land more or less out of a 40.0 acre tract in Nueces
County, Texas, out of A. B. E M. Survey 409, Abstract 555, said 40.0
acre tract being described in Vol. 100, Page 406, Deed Records of Nueces
County, Texas, and said 30.41 acre tract being described by metes and
bounds as follows:
BEGINNING at a nail in flasher bound in centerline of McKinzie Road at
NW corner of said 40.0 acre tract, for NW corner of this survey; THENCE
S. 89 deg. 58'45" E. with N. boundary of said 40.0 acre tract, at 40.0
ft. pass 1-1/2 inch iron pipe found on E. ROW line of McKinzie Road, in ,
all a distance of 2,649.71 ft. to a 1-1/2 inch iron pipe found by a post
on common survey line of B. A. & F. Survey 405, Abstract 567, and A.B. & M.
Survey 409, Abstract 555, for NE corner of said 40.0 acre tract and NE
corner of this survey; THENCE, 5. with said common survey line of Surveys
405 and 409, 500.00 ft. to a 5/8 inch iron rod set for NE corner of a

26.37 acre tract of land more or less, out of a 40.0 acre tract in
Nueces County, Texas, out of A.B. & M. Survey 409, abstract 555,
said 40.0 ac. tract being described in Vol. 100, pg. 406, Deed
Records of Nueces County, Texas, and said 26.37 acre tract being
described by metes and bounds as follows;
Beginning at a nail in flasher bound on the centerline of McKinzie
Rd. at the N/W corner of said 40.0 acre tract for the N/W corner of
the tract herein described;
Thence S 89° 58' 45" E with the north boundary line of said 40.0
acre tract, at 40.0 feet pass a 111 inch iron pipe found on the east
R.O.W. line of McKinzie Rd., in all a distance of 2,009.71 feet more
or less, to a point on the present city limit line, the S/W line of
a 40.0 foot water line dedicated easement, for the N/E corner of
this tract;
Thence S 50° 58' 45" E along said present city limit line, a dis-
tance of 750.0 feet more or less, to a point on the north boundary
line of a 29.33 acre tract for the S/E corner of this tract;
Thence N 89° 58' 45" W with the north boundary of said 29.33 acre
tract, at 2,084.59 feet more or less, pass a 5/8 inch iron rod set
for the N/W corner of said 29.33 acre tract and the N/E corner of
a 7.0 acre tract, and continuing N 89° 58' 45" W with the north
boundary line of said 7.0 tract, at 2,544.59 feet more or less,
pass a 5/8 inch iron rod set on the east R.O.W. line of McKinzie
Rd., in all a distance of 2,584.59 feet more or less, to a point

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
