HomeMy WebLinkAbout17428 ORD - 01/05/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CLIFF ZARSKY, TEXAN HOMES, BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1 AND 2, BEING A PORTION OUT OF THE 172 ACRE JOHN DUNN, SR., TRACT OUT OF THE "RINCON DEL OSO GRANT FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT ON TRACT 1 AND "B-4" GENERAL BUSINESS DISTRICT ON TRACT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Cliff Zarsky, Texan Homes, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 5, 1983, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts or parcels of land being described as Tracts 1 and 2 being a portion of the 172 acre John Dunn, Sr. tract out of the "Rincon del Oso Grant in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B' One -family Dwelling District to "R-2" Multiple Dwelling District on Tract 1 and to "6-4" General Business District on Tract 2: Tract 1 FIELDNOTES for 9.30 acres of land proposed for R-2 zoning out of the 172 acre John Dunn, Sr., tract out of the "Rincon del Oso Grant" granted by the Government of the State of Tamaulipas, Mexico, to E. Villareal and being out of that certain 39.60 acre tract conveyed by John Dunn to Rt. Rev. Emanuel B. Ledvina by deed recorded in Volume 170, Pages 299 thru 301, deed records of Nueces County, Texas and being out of that certain 41.17 acre tract described in a second amendment to right-of-way and SEP 2 p 19R4 117428 MICRUFJLMED easement agreement by Benedictine Fathers of Texas to Champlin Petroleum Company, recorded in Volume 1687, Pages 325 thru 329, Deed Records of Nueces County, Texas; BEGINNING at the point of intersection of the West boundary line of said 41.17 acre tract and the existing North boundary line of Interstate Highway No. 37 for the Southeast corner Lot 14, Block 1, Academy Heights Unit 2, a map of which is recorded in Volume 42, Pages 101, 102, Map records of Nueces County, Texas and the Southwest corner of this tract; THENCE North 19° 26' 16" East, along the West subdivision line of the abovementioned Unit 2, at 519.85 feet pass the Northeast corner of said Unit 2, same being the Southeast subdivision corner of Academy Heights, a map of which is recorded in Volume 26, Page 85, of said map records and containing along the West subdivision of said Academy Heights, in all a distance of 1019.29 feet to a point on the Southwesterly boundary line of Lantana Street for the Northwest corner of this tract and the point of curvature of a circular curve to the left whose radius point bears South 88° 42' 41" East 603.00 feet and having a central angle of 51° 53' 19", a radius of 603.00 feet, a tangent distance of 293.38 feet and an arc length of 546.09 feet; THENCE with said curve to the left, along the Southwesterly boundary line of Lantana Street, 546.09 feet to a point for the point of tangency; THENCE South 50° 36' 00" East, along the abovementioned Southwesterly line of Lantana Street (60.00 feet wide), 392.24 feet to a point for the Northeast corner of this tract and the point of curvature of a circular curve to the right which has a central angle of 46° 05' 38", a radius of 100.00 feet, a tangent distance of 42.97 feet and an arc length of 81.17 feet; THENCE leaving the abovementioned Southwesterly line of Lantana Street, along said curve to the right, 81.17 feet to a point for the point of tangency and an inside corner of this tract; THENCE South 04° 05' 38" East 180.53 feet the aforementioned North boundary line Highway No. 37 for the southeast corner of THENCE South 85° 54' 22" West, along the Interstate Highway No. 37, 437.90 feet to angle point and a corner of this tract; THENCE North 86° 35' 55" West, continuing with the abovementioned North line, 375.45 feet to the POINT OF BEGINNING. to a point on of Interstate this tract; North line of a point for an Tract 2 FIELDNOTES for 0.76 acres of land proposed for B-4 zoning out of the 172 acre John Dunn, Sr., tract out of the "Rincon del Oso Grant" granted by the Government of the State of Tamaulipas, Mexico, to E. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspen- sion of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the -29th day of r, 39$27 /983 ATTEST.
