AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF FRED BRASELTON, BY CHANGING THE ZONING MAP .IN REFERENCE TO TRACTS V AND W, BEING A PORTION OUT OF LOTS 6 AND 7, SECTION 7, BOHEMIAN COLONY LANDS FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R -1C" ONE -FAMILY DWELLING DISTRICT; AND TRACTS X, Y, AND Z, BEING A PORTION OF LOT 7, SECTION 7, BOHEMIAN COLONY LANDS FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "13-1" NEIGHBORHOOD BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Fred Braselton, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 5, 1983, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts or parcels of land being described as Tracts V and W, being a portion of Lots 6 and 7, Section 7, Bohemian Colony Lands, in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B' One -family Dwelling District to "R -1C" One -family Dwelling District: Tract V Description of 5.100 acres of land, more or less, out of Lot 7, Section 7, Bohemian Colony Lands as shown by plat recorded in Volume A, Page 48 of the Map Records of Nueces County, Texas, and further described by metes and bounds as follows: BEGINNING at a point which is located at the Easternmost corner of a 50.00 foot wide drainage right-of-way dedicated by Plat of Three Fountains, Unit I, as shown in Volume 38, Pages 156 and 157 of the Map Records of Nueces SEP 2 8 1984 County, Texas, said beginning point for the Northernmost 17429 KICIJOBLMED. corner of this tract and being located in the Northeast boundary line of said Lot 7; THENCE S 61° 41' 45" E, 1219.21 feet along said Northeast boundary line of Lot 7 to a point in the Northwest right-of-way line of Martin Street; THENCE S 29° 00' 00" W, 40.09 feet along said Northwest right-of-way line of Martin Street to the point of curvature of a circular curve to the right whose central angle is 89° 26' 28" whose radius is 10.01 feet and whose tangent length if 9.91 feet; THENCE along the arc of said circular curve to the right a distance of 15.63 feet to the point of tangency, said point of tangency being in the Northeast right-of-way line of Dorado Street; THENCE along said Northeast right-of-way line of Dorado Street N 61° 33' 32" W 675.09 feet to a point for an interior Northerly corner of this tract, said corner being the point of intersection of the Northeast right-of-way line of said Dorado Street and Northwest right-of-way line of Hacala Street; THENCE along said Northwest right-of-way line of Hacala Street S 28° 51' 11" W, 294.12 feet to the point of curvature of a circular curve to the right, whose central angle is 89° 28' 00", whose radius is 10.00 feet, and whose tangent length is 9.91 feet; THENCE along the arc of said circular curve to the right, a distance of 15.62 feet to the point of tangency, said point of tangency being in the Northeast right-of-way line of Frio Street; THENCE along said Northeast right-of-way line of Frio Street N 61° 40' 49" W, 250.96 feet to the point of curvature of a circular curve to the left whose central angle is 12° 38' 28", whose radius is 1189.19 feet and whose tangent length is 131.72 feet; THENCE along the arc of said circular curve to the left being said Northeast right-of-way line of Frio Street a distance of 262.37 feet to a point for the Westernmost corner of this tract, said Westernmost corner being the Southeast corner of said Three Fountains, Unit I, Subdivision; THENCE N 26° 51' 55" E, 381.18 feet along the Southeast boundary line of said Three Fountains Unit I to the POINT OF BEGINNING. Tract W Description of 43.908 acres of land, more or less, out of Lots 6 and 7, Section 7, Bohemian Colony Lands as shown by plat recorded in Volume A, Page 48, of the Map Records of Nueces County, Texas, and further described by metes and bounds as follows: BEGINNING at a point in the Southeast boundary line of said Lot 7, which bears S 29° 00' 00" W, 89.00 feet as measured along said Southeast boundary line of Lot 7 from the Easternmost corner of said Lot 7, said beginning 5/8" iron rod for the Easternmost corner of this tract; THENCE S 29° 00' 00" W along said Southeast boundary line of Lot 7 at 1232.71 feet pass a 5/8" iron rod found at the common lot line between said Lots 6 and 7 and along the Southeast boundary line of said Lot 6, in all a distance of 1363.55 feet to a 5/8" iron rod set for a Southeast corner of this tract; THENCE N 60° 57' 31" W, 260.38 feet to a 5/8" iron rod set in said Lot 6 for the point of curvature of a circular curve to the left, having a central angle of 33° 22' 14", a radius of 922.60 feet and a tangent length of 276.54 feet; THENCE along the arc of said circular curve to the left a distance of 537.35 feet to the point of tangency in said Lot 6; THENCE S 85° 40' 15" W, 488.85 feet to a 5/8" iron rod set in said Lot 6 for a Southerly corner of this tract; That the zoning on the hereinafter described tracts or parcels of land being described as Tracts X, Y, and Z, being a portion of Lot 7, Section 7, Bohemian Colony Lands, in the City of Corpus Christi, Nueces County, Texas be changed from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District: Tract X Description of 4.021 acres of land, more or less, out of Lot 7, Section 7, Bohemian Colony Lands as shown by plat recorded in Volume A, Page 48 of the Map Records of Nueces County, Texas and further described by metes and bounds as follows: BEGINNING at a 5/8" iron rod set in the Southeast right-of-way line of Greenwood Drive for the Westernmost corner of this tract, which bears N29°03'58"E 5.00 feet from the intersection of the Southwest boundary line of said Lot 7 and the Southeast right-of-way line of Greenwood Drive; THENCE N29°03'58"E 463.10 feet along said Southeast right-of-way line of Greenwood Drive to a 5/8" iron rod found for the point of curvature of a circular curve to the right having a central angle of 89°27'00", a radius of 10.00 feet and a tangent length of 9.90 feet; THENCE along the arc of said circurlar curve to the right a distance of 15.61 feet to a 5/8" iron rod found at the point of tangency and being in the Southwest right-of-way line of Frio Street; THENCE along said Southwest right-of-way line of Frio Street S61°29'02"E 290.77 feet to a 5/8" iron rod found at the point of curvature of a circular curve to the left having a central angle of 03°48'51", a radius 1052.25 feet, a tangent length of 35.04 feet; THENCE along the arc of said circular curve, a distance of 70.05 feet to a 5/8" iron rod found for the Easternmost corner of this tract; THENCE S29°09'29"W 475.20 feet to a 5/8" iron rod found for the Southernmost corner of this tract; THENCE N61°30'24"W 369.89 feet along a line that is 5' Northeast of and parallel to the Southwest boundary line of said Lot 7 to the POINT OF BEGINNING. Tract Y Description of 2.409 acre of land, more or less, out of Lot 7, Section 7, Bohemian Colony Lands as shown by plat recorded in Volume A, Page 48 of the Map Records of Nueces County, Texas and further described by metes and bounds as follows: BEGINNING at a point in the Northeast right-of-way line of Frio Street for the Southernmost corner of this tract, said beginning point being located at the Westernmost corner of an existing 70' drainage right-of-way dedicated by plat of Three Fountains, Unit I as shown by plat recorded in Volume 38, Page 156 and 157 of the Map Records of Nueces County, Texas; THENCE N61°29'00"W along said Northeast right-of-way line of Frio Street 290.00 feet to the point of curvature of a circular curve to the right whose central angle is 90°33'00", whose radius is 9.90 feet and whose tangent length is 10.00 feet; THENCE along the arc of said circular curve to the right a distance of 15.65 feet to the point of tangency, said point of tangency' being in the Southeast right-of-way line of Greenwood Drive, said Southeast right-of-way line of Greenwood Drive being 40.00 feet off of and parallel to the centerline of said Greenwood Drive; THENCE N29°03'58"E along said Southeast right-of-way line of Greenwood Drive, 339.90 feet to a point for the Northernmost corner of this tract; THENCE S61°29'02"E 300.00 feet to a point for the Easternmost corner of this tract, said Easternmost corner being in the Northwest boundary line of said 70.00 foot wide drainage right-of-way; THENCE along said Northwest boundary line of 70.00 foot wide drainage right-of-way S29°03'58"W 349.90 feet to the POINT OF BEGINNING. Tract Z Description of 0.346 acres of land, more or less, out of Lot 7, Section 7, Bohemian Colony Lands, as shown by plat recorded in Volume A, Page 48 of the Map Records of Nueces County, Texas and further described by metes and bounds as follows: BEGINNING at a point in the Southeast right-of-way line of Greenwood Drive for the Northernmost corner of this tract, said Northernmost corner being located S61°32'50"E 40.00 feet from the Northernmost corner of said Lot 7, which is in the centerline of said Greenwood Drive; THENCE S61°32'50"E along the Northeast boundary line of said Lot 7, 300.00 feet to a point for the Easternmost corner of this tract, said Easternmost corner being the Northernmost corner of a 70.00 foot wide drainage right-of-way dedicated by plat of Three Fountains, Unit I as shown in Volume 38, Pages 156 and 157, Map Records of Nueces County, Texas; THENCE along the Northwest boundary line of said 70.00 foot wide drainage right-of-way, S28°59'50"W 50.33 feet to a point for the Southernmost corner of this tract; THENCE N61°29'02"W 300.00 feet to a point in the Southeast right-of-way line of Greenwood Drive for the Westernmost corner of this tract, said Southeast right-of-way line of Greenwood Drive being 40.00 feet off of and parallel to said centerline of Greenwood Drive; THENCE along said Southeast right-of-way line of Greenwood Drive N29°00'02"E 50.00 feet to the POINT OF BEGINNING. SECTION 4. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 5. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7.
