HomeMy WebLinkAbout17432 ORD - 01/12/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE BY NEWLY ANNEXED TERRITORY, BY ADDING SUBSECTION, 31-5.46 SETTING FORTH ON SAID, AREA OF LAND DESCRIBED AS AND 5, SECTION 11, BOHEMIAN COLONY AN EMERGENCY. AMENDING ARTICLE 31, TO SECTION 31-5 A NEW ZONING CLASSIFICATION A PORTION OF LOTS 2 LANDS; AND DECLARING WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Jack Ryan, Trustee, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all' persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 5, 1983, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "A-1" Apartment House District on Tract 1 and "R -1C" One -family Dwelling District, on Tract 2, being portions of Lots 2 and 5, Section 11, Bohemian Colony Lands, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels of tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare SEP 2 81QR4 MICROFILMED 174. of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.46, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described properties to be effective upon annexation: "Section 31-5.46. The following described tract of land shall be zoned and classified as follows: "A-1" Apartment House District on Tract 1 and "R -1C" One -family dwelling district on Tract 2 as more particularly described as follows: TRACT 1 FIELDNOTES for proposed "A-1" zoning of 19.23 acres, more or less, of land out of Lots 2, Section 11, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a point on the Northwest boundary line of Everhart Road for the South corner of this tract from which corner the East subdivision corner of Breckenridge Unit 1, a map of which is recorded in Volume 46, Pages 131 and 132 of said Map Records bears South 29° 05' 00" West 250.00 feet, more or less, thence North 61° 32' 00" West 20.00 feet, more or less; THENCE North 61° 32' 00" West leaving said Northwest boundary line of Everhart Road, 2040.76 feet, more or less, for the West corner of this tract; THENCE North 28° 28' 00" East 409.97 feet, more or less, for the North corner of this tract; THENCE South 61° 32' 00" East 2045.98 feet, more or less, to a point on said Northwest boundary line of Everhart Road for the East corner of this tract; THENCE South 29° 05' 00" West, with said Northwest boundary line, parallel to the centerline thereof and 20.00 feet, more or less, distant therefrom, measured at right angles thereto 410.00 feet, more or less, for the POINT OF BEGINNING. TRACT 2 FIELDNOTES for proposed "R -1C" zoning of 22.28 acres, more or less, out of Lots 2 and 5, Section 11, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a point of the existing Northwest boundary line of Everhart Road for the South corner of this tract from which corner the East subdivision corner of Breckenridge Unit 1, a map of which is recorded in Volume 46, Pages 131 and 132 of said Map Records bears North 61° 32' 00" West 20.00 feet, more or less; THENCE North 61° 32' 00" West, at 20.00 feet, more or less, pass said East subdivision corner, at 783.88 feet, more or less, pass the common North subdivision corner of said Breckenridge Unit 1 and the East subdivision corner of Breckenridge Unit 2, a map of which is recorded in Volume 46, Pages 137 and 138 of said Map Records, in all a distance of 2952.09 feet, more or less, to a point on the Southeast boundary line of a City of Corpus Christi 160.00 feet wide drainage right-of-way for the West corner of this tract; THENCE North 61° 39' 00" East, with the above mentioned Southeast boundary line, 675.82 feet, more or less, for the point of curvature of a circular curve to the left which has a central angle of 16° 16' 20", more or less, a radius of 367.94 feet, more or less, a tangent distance of 52.60 feet, more or less, and an arc length of 104.50 feet, more or less; THENCE, with said circular curve to the left, 104.50 feet, more or less, for the North corner of this tract; THENCE South 61° 32' 00" East 499.23 feet, more or less, for the most Northeast corner of this tract; THENCE South 28° 28' 00" West 409.97 feet, more or less, to an inside corner of this tract; THENCE South 61° 32' 00" East 2040.76 feet, more or less, to a point on said Northwest boundary line of Everhart Road for the East corner of this tract; THENCE South 29° 05' 00" West, with said Northwest boundary, 250 feet, more or less, for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first eading as an emergency measure this the Ioti day of 19 .
