HomeMy WebLinkAbout17452 ORD - 01/26/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF THE MOST REVEREND BISHOP THOMAS J. DRURY, BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION LOT 4, SECTION 8, BOHEMIAN COLONY LANDS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "A-2" APARTMENT HOUSE DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of The Most Reverend Bishop Thomas J. Drury, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 26, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tract of land described as a portion of Lot 4, Section 8, Bohemian Colony Lands, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "A-2" Apartment House District: Description of a twenty-five (25) acre tract of land out of Lot 4, Section 8, Bohemian Colony Lands Subdivision, as shown by map of record in Volume "A", Page 48, Map Records of Nueces County, Texas. BEGINNING at a point in the Northeast boundary of Saratoga Boulevard, also known as State Highway No. 357, a one hundred twenty (120) foot road, from whence, the point of intersection of the centerline of said Saratoga Boulevard with the centerline of Kostoryz Road, a sixty (60) foot road, bears S 29° 00' W, a distance of 60.00 feet and S 61° 28' 20" E, a distance of 230.00 feet. "174.12 OFII.MED 281984 Said point of intersection being the Southeast corner of Lot 4, Section 8, said Bohemian Colony Lands. THENCE, N 61° 28' 20" W, along the Northeast boundary of said Saratoga Boulevard, a distance of 930.38 feet to a point for Southwest corner of this description; THENCE, N 29° 00' E, a distance of 1145.15 feet to a point in the Southwest boundary of Richter Drainage Ditch, a 130 foot right-of-way, for the Northwest corner of this description; THENCE, S 61° 30' 30" E, along the Southwest boundary of said drainage ditch, a distance of 950.45 feet to a point for the Northeast corner of this description; THENCE, S 29° 00' W, along the Northwest boundary of said drainage ditch, a distance of 1135.75 feet to a point for corner; THENCE, N 87° 56' 30" W, a distance of 22.42 feet to the point of beginning and containing in all, a total of 25.0 acres of land. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect.' SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take ect upon first reading as an emergency measure this the a_ Q_-- day of O -al , 19 d.
