HomeMy WebLinkAbout17454 ORD - 01/26/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF H. J. EDABURN, BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF THE ORIGINAL TOM WHELAN 100 ACRE TRACT FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of H. J. Edaburn, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 26, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tract of land described as a portion of the original Tom Whelan 100 acre tract, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "I-2" Light Industrial District to "B-4" General Business District: 5.72 acres of land, more or less, out of the original Tom Whelan 100 acre tract recorded in Volume "P", page 416, deed records of Nueces County and out of Share "G" of the Mary McBride Partition recorded in Volume 94, page 540-547, of said deed records, Nueces County, Texas; BEGINNING at a 5/8 inch iron rod set on the present West right-of-way line of Navigation Boulevard for the Southeast corner of this survey from which corner of a 1 inch iron pipe found for the point of intersection of said right-of-way and South line of a 5.77 acre tract of land conveyed to J. R. Heldenfels, Trustee by deed from Continental Oil Company, recorded in Volume 530, page 534 of said deed records bears South 02° 24' 50" East 76.96 feet; 17454 MICROFILMED SEP 2 81984 THENCE South 85° 38' 55" West 580.57 feet to a 5/8 inch iron rod set for the Southwest corner of this survey; THENCE North 07° 30' 35" West 414.00 feet to a 5/8 inch iron rod set on the West projection of the South line of a 4.00 acre tract of land conveyed to Corpus Christi Broadcasting, Inc. by deed from James Whelan, et al, recorded in Volume 365, pages 138, 139 of said deed records for the Northwest corner of this survey; Thence North 82° 41' 45" East, along said West projection, at 128.0 feet, more or less, pass the Southwest corner of said 4.00 acre tract and continuing along the South line of said 4.00 acre tract, in all a distance of 580.00 feet to a 1 inch iron pipe found on said West right-of-way line of Navigation Boulevard for the Northeast corner of this survey. THENCE South 07° 44' 40" East, along said right-of-way, 421.09 feet for an angle point in said right-of-way and a corner of this survey; THENCE South 02° 24' 50" East, with the continuation of said right-of-way 22.91 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed aand shall take a jj ct upon first reading as an emergency measure this the • day of �� �� . � 19 03 ATTEST: ty Secretary MAYOR pro:r THE CITY OF CORPUS CHRISTI, TEXAS Corpus Christi, T t2`4 day of , 1983 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
