HomeMy WebLinkAbout17469 ORD - 02/09/1983 (2)AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF JOE HANSLER AND HENRY TUCKER, BY GRANTING A SPECIAL COUNCIL PERMIT ON A PORTION OF LOT 19, SECTION 54, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS FOR AN APARTMENT COMPLEX; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Joe Hansler and Henry Tucker for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, July 28, 1982, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted an apartment complex on a portion of Lot 19, Section 54, Flour Bluff and Encinal Farm and Garden Tracts, more fully described below, as shown on the site plan attached hereto and made a part hereof marked Exhibit "A" and all other considerations of "R -1B" One -family Dwelling District: The surface estate, in and to all of that certain tract or parcel of land lying and being situated in Nueces County, Texas and more particularly described as follows: Five (5) acres, more or less, in the form of a square out of the north corner of the south or southwest 3/4ths of Lot Nineteen (19), Section Fifty-four (54) of the Flour Bluff and Encinal Farm and Garden Tracts, Subdivision in the City of Corpus Christi, according to the map or plat thereof, recorded in Volume A, Pages 41, 42, and 43, Map Records, Nueces County, Texas, and described by metes and bounds as follows: BEGINNING at a point in the Northwest line of said Lot No. 19 at the intersection of said line with the MC OFILM ED a 74.ca9 SEP 2 81984 Southwest boundary line of road running through said Section No. 54, as shown by map thereof, recorded in Volume A, Page 42 of the Nueces County Map Records, for the north corner of this five acres; THENCE with the northwest boundary line of said Lot No. 19, S. 29° W., 466.662 feet for the west corner of this tract; THENCE S. 61° said Lot No. this tract; THENCE N. 29° said Lot No. 1 tract; E., parallel with the NE boundary line of 19, 466.662 feet for the south corner of E., parallel with the NW boundary line of 9, 466.662 feet for the east corner of this THENCE N. 61° W., with SW boundary line of said road, 466.662 feet to the PLACE OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take a fect upon first reading - as an emergency measure this the day of p.��,t..v , 19 03 .
