AN ORDINANCE
AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW
SUBSECTION, 31-5.48 SETTING FORTH ZONING CLASSIFICATION
ON SAID AREA OF tAND DESCRIBED AS A PORTION OF LOT 8,
SECTION 19, BOHEMIAN COLONY LANDS; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of B & G Custom
Building for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, February 9,
1983, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "R-2" Multiple
Dwelling District on Tract 1 and "R -1B" One -family Dwelling District on Tract
2, being portions of Lot 8, Section 19, Bohemian Colony Lands, Nueces County,
Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels of
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:

SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.48, said new
subsection to hereafter read as follows, such zoning classification of the
hereinafter described properties to be effective upon annexation:
"Section 31-5.48. The following described tract of land shall be
zoned and classified as follows:
"R-2" Multiple Dwelling District on Tract 1 and "R -1B" One -family
Dwelling District on Tract 2
Tract 1
FIELDNOTES for proposed R-2 zoning of 5.99 acres of land,
more or less, out of Lot 8, Section 19, Bohemian Colony
Lands, a map of which is recorded in Volume A, Pages 48,
Map Records of Nueces County, Texas:
BEGINNING at a point on the centerline of County Road No.
26 for the East corner of this tract from which corner a
1 inch iron pipe found on said centerline for the East
corner of said Lot 8 bears South 61° 32' 00" East 500.00
feet, more or less;
THENCE South 28° 28' 00" West, leaving said centerline,
at 20.00 feet, more or less, pass the Southwest boundary
line of County Road No. 26, in all a distance of 210.00
feet, more or less, for the point of curvature of a
circular curve to the right which has a central angle of
76° 14' 53", a radius of 175.00 feet, more or less, a
tangent distance of 137.34 feet, more or less, and an arc
length of 232.89 feet, more or less;
THENCE, with said circular curve to the right, 232.89
feet, more or less, for point of tangency;
THENCE North 75° 17' 07" West 210.00 feet, more or less,
for the point of curvature of a circular curve to the
right which has a central angle of 58° 19' 07", a radius
of 175.00 feet, more or less, a tangent distance of 97.64
feet, more or less, and an arc length of 178.12 feet,
more or less;
THENCE, with said circular curve to the right, 178.12
feet, more or less, for the point of tangency;
THENCE North 16° 58' 00" West 395.10 feet, more or less,
to a point on the Southerly boundary line of a 160.00
foot wide City of Corpus Christi drainage right-of-way
for the West corner of this tract;
THENCE North 73° 02' 00" East, along the Southerly
boundary line of the 160 foot wide drainage right-of-way,
42.52 feet, more or less, for the point of curvature of a
circular curve to the left which has a central angle of
11° 23' 00", a radius of 367.94 feet, more or less, a
tangent distance of 36.67 feet, more or less, and an arc
length of 73.10 feet, more or less;

abovementioned Southerly line of said drainage, 73.10
feet, more or less, for the point of tangency;
THENCE North 61° 39' 00" East, at 0.27 feet, more or less
pass the aforementioned Southwest boundary line of County
Road No. 26, in all a distance of 24.17 feet, more or
less to a point on the centerline of said County Road No.
26, same being the Northeast line of said Lot 8 for the
North corner of this tract;
THENCE South 61° 32' 00" East, along the abovementioned
centerline, with the Northeast line of said Lot 8, 694.41
feet, more or less to the POINT OF BEGINNING.

BEGINNING at a 1 inch iron pipe found on the centerline
of County Road 26 (40.00 feet wide) for the East corner
of said Lot 8 and the East corner of this tract;
THENCE South 29° 00' 00" West, along the Southeast
boundary line of said Lot 8, at 20.00 feet, more or less,
pass the Southwest boundary line of said County Road No.
26, in all a distance of 1,320.25 feet, more or less, to
a 1 inch iron pipe found to mark the South corner of said
Lot 8 and the South corner of this tract;
THENCE North 61° 32' 00" West, along

less, pass the aforementioned Southwest boundary line of
County Road No. 26, in all a distance of 210.00 feet,
more or less, to a point said centerline for a corner of
this tract;
THENCE South 61° 32' 00" East, along the abovementioned
centerline, with the Northeast line of said Lot 8, 500.00
feet, more or less, for the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take e ect upon first reading as an emergency measure this the /

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
