AMENDING THE ELECTRICIAN LICENSE ORDINANCE OF THE CITY
CODE, TO AUTHORIZE AN EXAMINATION COMMITTEE TO COMPOSE,
ADMINISTER, AND GRADE LICENSE EXAMINATIONS; OTHER
PROVISIONS RELATING TO LICENSE APPLICATIONS, REPORTS TO
THE ELECTRICAL ADVISORY BOARD AND APPEALS; AND PROVIDING
FOR SEVERANCE AND PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Code of Ordinances of the City of Corpus
Christi, Texas, Chapter 13, Building, Article III, Electrical, Division 1,
Licensing, Sections 13-62 through 13-80 be amended as follows:
(a) That Section 13-62 be amended to hereafter read as follows:
The Board shall at its first meeting in each calendar
year select a Chairman and a Vice Chairman and prescribe
a procedure and order of business for hearing matters
brought to it as provided herein, and for general
business session.
(b) That paragraph (c) of Section 13-63 be amended by deleting the
second sentence thereof in its entirety so that said paragraph shall
hereafter read as follows:
Records: The board shall keep a minute book in which
shall be recorded all transactions and business of the
board.
(c) That paragraph (a) of Section 13-64 be amended by amending the
first sentence thereof to hereafter read as follows:
It shall be the duty of an examination committee,
comprised of the building official, the chief electrical
inspector, and the permit officer to pass upon the
qualifications of all applicants for licenses.
(d) That paragraph (b), subparagraph (4), of Section 13-64 be
amended to hereafter read as follows:
(4) Where the licensing ordinance of another city has
been examined and the licensing procedure approved by the
examination committee, the building official may issue
the applicant an electrician license, provided such city
permits electricians from Corpus Christi to obtain
electrician's licenses under procedures similar to the
above; and further provided that the electrician
examinations of those cities are reviewed by the
examination committee to determine if said examinations
are comparable to City of Corpus Christi examinations.
(e) That paragraphs (c), (d), and (e) of Section 13-64 are amended
by substituting the term "examination committee" for the term "board"
wherever it appears in said paragraphs.

(f) That paragraph (f) of Section 13-64 be amended to hereafter
read as follows:
Any applicant who has failed three (3) examinations may
appeal the examination committee's failure to license him
to the assistant city manager, who will appoint a special
board for the purpose of considering whether such
applicant should be licensed. This special board shall
consist of a licensed master electrician, an electrical
engineer, registered to practice in the state, and a
mechanical engineer, registered to practice in the state.
The special board may, in considering an appeal, review
the examinations previously administered by the
examination committee or, at its option, prepare,
administer and grade a special examination. The action
of this special board shall be reported to the city
manager with a recommendation based on their
investigations, and the action of the assistant city
manager will constitute final action on the appeal.
(g) That paragraph (g) of Section 13-64 be amended to hereafter
read as follows:
In the event the references or the past experience record
of the applicant is unsatisfactory to the examination
committee, and the examination committee fails to
license him on that account, the applicant shall have the
right to appeal to the assistant city manager for the
appointment of a special board having the same
qualifications as the special board used in case of
failure of the examination and said special board shall
make an independent inquiry of references and an
independent investigation of past experience record and
make its report and recommendation to the assistant city
manager, and the action of the assistant city manager
will constitute final action on the appeal.
(h) That Section 13-65 be amended in its entirety to hereafter
read as follows:
Content of Examinations.
(a) The board shall prepare and recommend examinations
to be administered by the examination committee. The
board shall also appoint a subcommittee of its members to
assist the examination committee in reviewing
applications for licenses and monitoring and grading
examinations.
(b) Examinations selected by the examination committee
shall be of uniform language, fair, and impartial in
nature, and shall test the knowledge and skill of each
applicant to do electrical work involving the
installation, alteration, repair and maintenance of
electrical conductors and equipment. Examinations shall
be graded at the earliest convenience of the examination
committee, and upon the applicant scoring seventy percent
(70%) or more on the examination the appropriate license
shall be issued. The examination committee shall provide
a monthly report to the board of examining and licensing
activity, including licenses issued under Section
13-64(b).
(i) That paragraph (a) of Section 13-66 be amended by amending the
first sentence thereof to read as follows:
The board may recommend that the city council suspend or
revoke the license of any electrician who is found guilty
of:
(j) That paragraph (b) of Section 13-66 be amended by amending the
last two sentences thereof to read as follows:
If the accused pleads guilty, or if, upon a hearing of
the charge, the board shall find any of the charges to be
true, it may recommend suspending or revoking the license
of such electrician.
(k) That paragraph (c) of Section 13-66 be amended in its entirety
to hereafter read as follows:
When the board has completed such hearing, it shall cause
a record of its finding and recommendation to be filed
with the city secretary to be submitted for consideration
by the city council. The board shall also forward a
certified copy of same to the accused.
(1) That paragraphs (d) and (e) of Section 13-66 be amended to
hereafter read as follows:
(d) The city council shall as soon as practicable after
receiving the board's recommendation shall set a hearing
to either adopt, amend or reject the recommendation of
the board. Notice of said hearing shall be given the
accused by registered mail at least five (5) days prior
to the date thereof. In the event an order is entered
suspending or revoking the license of such electrician,
the city council may make provision for reinstatement
based upon written notice by the examination committee at
the expiration of a specified period, or by the suspended
person satisfactorily passing an examination given for
the same grade of electrician from which he was
suspended. Such order of reinstatement shall be filed as
a part of the record and a copy shall be made and given
or mailed to the person so reinstated.
(e) It shall be unlawful for any person, firm or
corporation whose rights under a license have been
suspended or revoked by the city council to engage in or
do electrical work for which a permit is required by the
electrical code.
(m) That paragraph (a) of Section 13-73 be amended in its entirety
to hereafter read as follows:
To secure a license as a qualified and competent
electrician in any of the classes set out in Section
13-72, an application shall be made in writing and
addressed to the building official. The application
shall show the applicant's name and address, and such
other information as may be prescribed by the examination
committee, and shall be made out on forms available in
the office of the chief electrical inspector.
(n) That the first paragraph of Section 13-75 be amended by
deleting the term "board" appearing as the last word of said paragraph and
substituting in its place the term "examination committee."
(o) That the first sentence of Section 13-76 be amended by
deleting the term "board" as used therein and substituting in its place the
term "examination committee."
(p) That Section 13-80 be amended by deleting the term "board" as
used therein and substituting in its place the term "examination committee."
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption of this
ordinance, stating in substance the purpose of the ordinance.
