AMENDINGTHE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW
SUBSECTION, 31-5.47 SETTING FORTH ZONING CLASSIFICATION
ON SAID AREA OF LAND DESCRIBED AS A PORTION OF LOTS 15
AND 16, SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND
GARDEN TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Tri-Star
Development Company for amendment to the zoning map of the City of Corpus
Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, February 9,
1983, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-4" General
Business District, being portions of Lots 15 and 16, Section 6, Flour Bluff
and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully
described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels of
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.47, said new
subsection to hereafter read as follows, such zoning classification of the
hereinafter described properties to be effective upon annexation:
"Section 31-5.47. The following described tract of land shall be
zoned and classified as follows:
"B-4" General Business District
FIELDNOTES for proposed B-4 zoning of 15.76 acres of
land, more or less, out of Lots 15 and 16, Section 6,
Flour Bluff & Encinal Farm & Garden Tracts, a map of
which is recorded in Volume A, Pages 41-43 of the Map
Records of Nueces County, Texas:
BEGINNING at the West corner of said Lot 16, same being
the centerline intersection of Everhart Road and Yorktown
Boulevard, for the West corner of this tract;
THENCE North 29° 02' 30" East, along the centerline of
Everhart Road, same being the Northwest section line of
Section 6, 880.00 feet, more or less, to a 1 inch iron
pipe found for the North corner of this tract;
THENCE South 61° 57' 25" East, leaving said centerline,
at 20.00 feet pass the Southeast boundary line of
Everhart Road, in all a distance of 779.77 feet, more or
less, to the East corner of this tract;
THENCE South 29° 02' 30" West, at 860.49 feet, more or
less, pass the Northeast boundary line of Yorktown
Boulevard (unimproved), in all a distance of 880.49 feet,
more or less, to a point on the centerline of Yorktown
Boulevard for the South corner of this tract;
THENCE North 60° 55' 15" West, along the above mentioned
centerline, same being the Southwest lot line of said
Lots 15 and 16, 779.77 feet, more or less, to the Point
of Beginning.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take ffect upon first reading as an emergency measure this the

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
