HomeMy WebLinkAbout17485 ORD - 02/16/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF SILVERIO VALENCIA, BY GRANTING A SPECIAL COUNCIL PERMIT ON LOTS 8, 9, AND A PORTION OF LOT 10, BLOCK 1, BEST ADDITION, FOR A DUPLEX; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Silverio Valencia for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, February 16, 1983, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted for a duplex on Lots 8, 9, and a portion of Lot 10, Block 1, Best Addition, more fully described below, as shown on the site plan attached hereto and made a part hereof marked Exhibit "A" and all other considerations of "I-2" Light Industrial District: A 0.4193 acre tract of land, more or less, being all of Lot 8, 9, and the West 40.00 feet of Lot 10, all being out of the Best Addition as recorded in Volume 10, Page 21, Nueces County Map Records, being more particularly described by metes and bounds as follows: COMMENCING at an iron pipe being the Southwest corner of Lot 1, Block 1, of the said Best Addition, recorded in Volume 10, Page 21, Nueces County Map Records, and being the Northeast corner of McBride and Union Lane. THENCE S 78° 22' E with the North right of way of Union Lane a distance of 373.42 feet to an iron pipe for POINT I 7485 SEP 2 ti 19114 VCROVILMED. OF BEGINNING, said iron pipe being the South common corner of Lot 7 & 8, Block 1, of said Best Addition, also being the Southwest corner of this tract. THENCE N 11° 38' E with the common line of Lot 7 & 8, Block 1, a distance of 130.46 feet to an iron pipe for the Northwest corner of this tract. THENCE S 78° 22' E with North line of Lot 8 at 50.00 feet passing the common corner of Lot 8 & Lot 9 and at 100.00 feet passing the common corner of Lot 9 & Lot 10, in all a distance of 140.00 feet to the Northeast corner of this tract. THENCE S 11° 38' W with the East line of this tract a distance of 130.46 for an iron pipe for this Southeast corner of this tract, and also being on the North R.O.W. of Union Lane ('50.00 R.O.W.). THENCE N 78° 22' W with the North R.O.W. of said Union Lane, at 40.00 passing the common corner of Lot 9 & Lot 10, and at 90.00 feet, passing the common corner of Lot 8 & Lot 9 in all a distance of 140.00 feet to POINT OF BEGINNING and containing 0.4193 acres more or less. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and IL— shall takefect upon first reading as an emergency measure this the %(O day ofti , 19 03 .
