AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 1 TO THE
CONTRACT WITH ASPHALT PAVING AND CONSTRUCTION COMPANY
(APCCO) FOR THE SPOHN HOSPITAL AREA STREET IMPROVEMENTS
PROJECT WHICH PROVIDES FOR THE RECONSTRUCTION OF THE EAST
SIDE OF FIFTH STREET FROM BOOTY STREET TO AYERS STREET;
APPROPRIATING $8,440.90; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute Change
Order No. 1 to the contract with Asphalt Paving and Construction Company
(APCCO) for the Spohn Hospital Area Street Improvements project which
provides for the reconstruction of the east side of Fifth Street from Booty
Street to Ayers Street, a copy of which change order is attached hereto and
made a part hereof marked Exhibit "A".
SECTION 2. That there is hereby appropriated $8,440.90 of which
$4,956.00 is from the No. 220 Street Bond Fund and $3,484.90 is from the
Sixth Year Community Development Block Grant Program, Project No.
162-152-807.04, Code 502, Spohn Hospital Area Street Improvements, applicable
to Project No. 220-77-2.15, Spohn Hospital Area Street Improvements.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
take immediate action to preserve and protect public property by expediting
the construction of public improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that this
ordinance is passed and shall take of ect upon first reading as an emergency

Why was this change necessary? (If left off the plans and specifications, explain why.)
This street was transferred from the second phase of the project at the request of
the abutting property owners. The street being added is 5th Street from Booty to Ayers.
How can similar changes be avoided in the future? More thorough investigation during
design stage.
