AUTHORIZING THE EXECUTION OF -AN AGREEMENT WITH W. R.
HUBLER PROVIDING FOR CITY PARTICIPATION IN THE
CONSTRUCTION OF A LIFT STATION, SEWER GRAVITY LINES AND
SANITARY SEWER FORCE MAIN OVERSIZING COINCIDENTAL WITH
THE DEVELOPMENT OF THE HURLER TRACT; APPROPRIATING
$25,020.62 FOR THIS AGREEMENT; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
an agreement with W. R. Hubler providing for City participation in the
construction of a lift station, sewer gravity lines, and sanitary sewer force
main oversizing coincidental with the development of th "Hubl r Tract, a copy
of which agreement is attached hereto and made a part hereof, marked Exhibit
SECTION 2. That there is hereby appropriated $25,020.62 from the
No. 250 Sanitary Sewer Bond Fund for force main oversizing applicable to
Project No. 250-67-54, McArdle Lift Station and Force Main.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
take immediate action to preserve and protect public property by expediting
the construction of public improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that this
ordinance is passedc�and shall take effect upon first reading as an emergency
measure this thecC7 day of March, 1983.

THIS AGREEMENT is entered into between the City of Corpus Christi, Texas,
hereinafter called "City", and W. R. Hubler, hereinafter called "Builder", and
pertains to costs for sanitary sewer improvements coincidental with the
development of the Hubler Tract Subdivision, consisting of 15.77 acres.
WHEREAS, the Builder is required to provide sanitary sewer service to
Hubler Tract Subdivision per the City Platting Ordinance; and
WHEREAS, per a previous agreement authorized by Ordinance No. 16465, the
City shall reimburse the Builder up to a maximum of $50,000 towards the
construction of a lift station and sewer gravity lines, and additionally, the
City shall pay the difference in the cost attributable to oversizing the
required sanitary sewer force main from a 6" to 12" diameter line for the
purpose of providing sewer service to the area shown on attached Exhibit "A";
and
NOW, THEREFORE, the City and Builder agree as follows:
1. The Builder agrees to finance and construct, or cause to be
constructed, the required lift station, force main, and gravity sewer line as
shown on Exhibit "A".
2. The City agrees to reimburse the Builder for the maximum cost of the
construction of the lift station and gravity lines, as stated in the previous
agreement authorized by Ordinance No. 16465, the sum of Fifty Thousand and
no/100 Dollars ($50,000.00) and, in addition, the oversize cost of construction
of the 12" diameter force main plus engineering as shown on Item A of the
attached Construction Cost Estimate marked Exhibit "B". For purposes of this
agreement, the amount of the City reimbursement to the Builder for the force
main shall not exceed Twenty Five Thousand Twenty and 62/100 Dollars
($25,020.62).
3. The actual reimbursements for Items 3 and 4 will be adjusted according
to the actual construction costs after completion of the work but in no event
shall they exceed the above stated amounts. The City's payments to the
Builder will be made within thirty (30) days after completion and acceptance of
all subdivision improvements and upon receipt, from the Engineer, of
verification of the final construction quantities and costs.

4. The Builder agrees to indemnify the City against any claims arising as
a result of this project.
5. The Builder further agrees, in compliance with Ordinance No. 17112, to
complete, as part of this agreement, the Disclosure of Interests form attached
hereto and labeled Exhibit "C".
6. This agreement shall become effective and shall be binding upon and
shall inure to the benefit of the parties hereto and their respective heirs,
successors, and assigns from and after the date of execution.
