WHEREAthe Planning Commission has forwarded to the City Council its reports and re:.nnnendations concerning the application of Adolf, Joe, Manuel, Alfonso, and sa Gonzales for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public 'earing was held at which hearing all persons wishing to appear and be hea • were heard, to consider the same before the City Council of the City of Cor us Christi, in accordance with proper notice to the public, said public -aring having been held on Wednesday, March 2, 1983, at Special Council -eting of the City Council in the Council Chamber at City Hall in the City of .rpus Christi; and WHEREAS, by motion duly made seconded and carried, it was decided by the City Council that to approve the -reinafter set forth amendment would best serve public health, necessity and c nvenience and the general welfare of the City of Corpus Christi and its citize s: NOW, THEREFORE, BE IT ORDAINED BY E CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinan•e of the City of Corpus Christi, Texas, is amended by making the change her:inafter set out. SECTION 2. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Adolf, Joe, Manuel, Alfonso, and Rosa Gonzales for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, October 6, 1982, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit for 24 months be granted for an apartment project on a portion of Lot 12 Section D, Paisley's Subdivision of the Hoffman Tract, more fully described below, as shown on the site plan attached hereto and made a part hereof marked Exhibit "A" and all other considerations of "R -1B" One -family Dwelling District: FIELDNOTES for 5.02 acres of land proposed for A-1 zoning out of Lot 12, Section D, Paisley's Subdivision of the Hoffman Tract, a map of which is recorded in Volume A, Page 28, Map records of Nueces County, Texas; BEGINNING at the point of intersection of the centerline right-of-way (60.00 feet) of Gollihar Road and the' Northwest Subdivision line of Gollihar Park Subdivision Unit 2, a map of which is recorded in Volume 16, Page 1 of said map records for the East corner of this tract /75()/ from which corner the East corner of said Lot 12 bears North 28° 20' 00" East 10.00 feet; THENCE South 28° 20' 00" West, along the Southeast boundary line of said Lot 12 and the Northwest Subdivision line of the above mentioned Unit 2, at 30.00 feet pass the Southwest right-of-way line of Gollihar Road, in all a distance of 875.00 feet to a point for the South corner of this tract; THENCE leaving said Northwest Subdivision line, North 61° 40' 00" West 250.00 feet to a point for the West corner of this tract; THENCE North 28° 20' 00" East, at 845.00 feet pass the above mentioned Southwest line of Gollihar Road, in all a distance of 875.00 feet to a point on the existing centerline of said 60.00 foot wide Gollihar Road for the North corner of this tract; THENCE South 61° 40' 00" East, along the above centerline of Gollihar Road, 250.00 feet to the Point of Beginning. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of ��� , 19 23 . Bruce Aycock, City Attorney SUBJECT: Ordinance No. 17501 - Correction Request DATE: September 24, 1984 The attachments to your memo of September 20, 1984, have been reviewed by me including the minutes of public hearing on October 6, 1982, the agenda item for March 2, 1983, as well as the agenda request. Also I listened to the audio tape of the October 6, 1982, hearing. I agree with you that the request was for a 24 month special permit and this was what the Council approved on October 6, 1982, and again on March 6, 1983. I recommend that Ordinance No. 17501 should be corrected by adding the words "for 24 months" after "Special Council Permit" in Section 2. A corrected version is attached. Martin, City Manager Date October 4, 1984 FROM Larry H. Wenger, Director of Planning SUBJECT Zoning Application No. 882-12 - Messrs. Adolf, Joe, Manuel and Alfonso Gonzales and Ms. Rosa Gonzales The City Council, on March 2, 1983, denied "A-1" Apartment House zoning and in lieu thereof granted a Special Permit Ordinance No. 17501 for the development of a HUD 202 Senior Citizens Housing Project containing a total of 68 units as indicated on Attachment "A". The Special Permit granted the applicants two years in which to start construction of this project. As a result of the time period, funding was reduced by HUD, therefore, the applicants found it necessary to revise their original program to construct only 55 units and also move the units closer to Gollihar Road so as to reduce additional costs such as access drives to parking areas. As a result of these revisions, the park and recreation area has been moved to the rear of the structures, rather than being next to the street as indicated on Attachment "Bn This new site plan, Attachment "B", meets City Standards and, therefore, the City Staff recommends that the City Council, by motion, approve the revision of the site plan attached to Special Permit Ordinance No. 17501. 46A1 aair7 H.
