HomeMy WebLinkAbout17507 ORD - 03/02/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW SUBSECTION, 31-5.49 SETTING FORTH ZONING CLASSIFICATION ON SAID AREA OF LAND DESCRIBED AS TRACT A AND TRACT B, PORTIONS OF LOT 8, SECTION 20, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of W. H. Hammonds for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, March 2, 1983, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "B-4" General Business District on Tract A and "A-1" Apartment House District on Tract B, being portions of Lot 8, Section 20, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels of tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 75n7 MCROFILMEI5 SEP 281994 j 1r' SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.49, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described properties to be effective upon annexation: "Section 31-5.49. The following described tract of land shall be zoned and classified as follows: Tract A "B-4" General Business District FIELDNOTES for 10.55 acres of land proposed for B-4 zoning out of Lot 8, Section 20, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41-43, map records of Nueces County, Texas; BEGINNING at a 5/8 inch iron rod found at the point of intersection of the common boundary line of Lots 7 and 8 said Section 20 and the Southwest boundary line of Saratoga Boulevard for the North corner of this tract from which corner the North corner of Lot 8 and the East corner of Lot 7 bears Noreth 29° 04' 30" East 60.00 feet; THENCE South 60° 55' 30" East, along the Southwest line of Saratoga Boulevard, parallel to the centerline thereof and 60.00 feet distant therefrom, measured at right angles thereto, 86.89 feet to a 5/8 inch iron rod set for the point of curvature of a circular curve to the right which has a central angle of 89° 59' 30", a radius of 513.00 feet, a tangent distance of 512.93 feet and an arc length of 805.74 feet; THENCE with said curve to the right, along the boundary line of Saratoga Boulevard, 805.74 feet to a 5/8 inch iron rod set on the Northwest boundary line of Rodd Field Road for the point of tangency; THENCE South 29° 04' 00" West, along the Northwest boundary line of Rodd Field Road, parallel to the centerline thereof and 60.00 feet distant therefrom, measured at right angles thereto, 347.07 feet to a point for the South corner of this tract; THENCE leaving said Northwest line of Rodd Field Road, North 60° 55' 30" West 599.94 feet to a point on the common boundary line of Lots 7 and 8 for the West corner of this tract; THENCE North 29° 04' 30" East, along said common boundary line of Lots 7 and 8, 860.00 feet to the Point of Beginning. Tract B "A-1" Apartment House District FIELDNOTES for 5.51 acres of land proposed for A-1 zoning out of Lot 8, Section 20, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41-43, map records of Nueces County, Texas: BEGINNING at a 5/8 inch iron rod set to corner of Lots 7, 8, 9, 10, said Section corner of this tract; THENCE North 29° 04' 30" East, along the line of said Lots 7 and 8, 400.00 feet to North corner of this tract; mark the common 20 and the West common boundary a point for the THENCE South 60° 55' 30" East, leaving the above mentioned common boundary line, 599.94 feet to a point on the Northwest boundary line of Rodd Field Road for the East corner of this tract; THENCE South 29° 04' 00" West, along the Northwest boundary line of Rodd Field Road, parallel to the centerline thereof and 60.00 feet distant therefrom, measured at right angles thereto, 400.00 feet to its intersection with the common boundary line of said Lots 8 and 9 for the South corner of this tract; THENCE North 60° 55' 30" West, along the common boundary line of Lots 8 and 9, 600.00 feet to the Point of Beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
