C AN ORDINANCE ANNEXING A PARCEL OR TRACT OF LAND, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER ARTICLE I, SECTION 2(c), PROVIDING FOR THE ANNEXATION TO THE CITY OF CORPUS CHRISTI OF ROADS, HIGHWAYS, AND STREETS ADJACENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, on the 16th day of February, 1983, a public hearing was duly held at the Regular Council Meeting of the City Council, following publication of due notice of said hearing in the official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of proceedings for the annexation of a defined area wholly within the extraterritorial jurisdiction of Corpus Christi, including a portion of Burleson Street, more fully described hereinafter, at which all interested cpersons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed on February 16, 1983; and WHEREAS, it has been determined by the City Council that the territory above mentioned, and now proposed to be annexed, abuts and is contiguous and is adjacent to the City of Corpus Christi and constitutes lands and territories used for public purposes and which is owned by any governmental subdivision, or dedicated to a public use within the meaning of the City Charter, Article I, Section 2(c); and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid hereinafter more fully described area: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby annexed a portion of Burleson Street, more fully described hereinafter by metes and bounds, to -wit: BEGINNING at a point, the intersection of the present city limit line and the present Southwest right-of-way line of Burleson Street for the Southeast corner of the tract herein described; THENCE in a Northwesterly di Southwest right-of-way line distance of 1,265 feet, more intersection of said Southwest Southwesterly extension of the a 5.10 acre tract of land, now Corporation, for the Southwest rection with the present of Burleson Street, a or less, to a point, the right-of-way line and the Northwest boundary line of or formerly owned by Hitox corner of this tract; WSJ 19516 p 2 8 i9B4 C THENCE in a Northeasterly direction, with the Northwest boundary line (extended) of said 5.10 acre tract, a distance of 60 feet, more or less, to the Southwest corner of the 5.10 acre tract on the present Northeast right-of-way line of Burleson Street for the Northwest corner of this tract; THENCE in a Southeasterly direction with the present Northeast right-of-way line of said Burleson Street, a distance of 1,265 feet, more or less, to a point, the intersection of said present Northeast right-of-way line and the present city limit line for the Northeast corner of this tract; THENCE in a Southwesterly direction with said present city limit line, a distance of 60 feet, more or less, to the POINT OF BEGINNING, containing 1.74 acres, more or less. The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter of the City of Corpus Christi and the ordinances, resolutions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the fact that the above named landowners desire an immediate contract with the City for annexation and the City finds that it is in the public interest to bring said territory into the corporate limits as rapidly as possible, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular • / • // / / SCALE "= 4•00' iG 785 Ac ON THIS MAP. meetings so that this ordinance is passed and take effect upon first reading as an emergency this the J day of fettruar, ,, 1983. ` y ATTEST: APPROVED:/6 DAY OF FEBRUARY, 1983: J.
