CLOSING AND ABANDONING NOLAN AVENUE RIGHT-OF-WAY FROM A
POINT 42 FEET SOUTH OF THE CENTERLINE OF McARDLE ROAD TO
ITS PRESENT DEAD END 544.34 FEET SOUTH; A 5 FOOT WIDE
UTILITY EASEMENT IN BLOCK 2 AND THAT PORTION OF A 5 FOOT
WIDE EASEMENT ALONG THE SOUTH SIDE OF LOT 10, BLOCK 3, OF
SHERWIN PLACE UNIT 2; LUM AVENUE FROM A POINT 42 FEET
SOUTH OF THE CENTERLINE OF McARDLE ROAD TO ITS PRESENT
DEAD END 544.34 FEET SOUTH AND THE 5 FOOT WIDE UTILITY
EASEMENTS SHOWN BY SAID SHERWIN PLACE UNIT 1 PLAT IN
BLOCKS 1 AND 2; PROVIDING FOR REPLATTING; AND DECLARING
AN EMERGENCY.
WHEREAS, a right-of-way exists from a point 42 feet south of the
centerline of McArdle Road to its present dead end 544.34 feet south, shown
by plat of Sherwin Place Unit 2, in Volume 18, Page 32, Map Records, Nueces
County, Texas, and there exists 5 foot wide utility easements shown by said
Sherwin Place Unit 2 plat, being all that 5 foot wide utility easement in
Block 2 and that portion of 5 foot wide easement along the south side of Lot
10, Block 3, and there exists a right-of-way on Lum Avenue from a point 42
feet south of the centerline of McArdle Road to its present dead end 544.34
feet south, shown by plat of Sherwin Place Unit 1, recorded in Volume 16,
Page 50, Map Records, Nueces County, Texas and the 5 foot wide utility
easements shown by said Sherwin Place Unit 1 plat in Blocks 1 and 2; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said utility easements
and rights-of-way provided that applicant replat all affected properties,
pay $4,224.00 to the City for the relocation and abandonment of existing
utilities, and remove all existing street improvements and install curbs,
gutters and sidewalks across subject streets at McArdle Road.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That a right-of-way from a point 42 feet south of the
centerline of McArdle Road to its present dead end 544.34 feet south, shown
by plat of Sherwin Place Unit 2, in Volume 18, Page 32, Map Records, Nueces
County, Texas, and 5 foot wide utility easements shown by said Sherwin Place
Unit 2 plat, being all that 5 foot wide utility easement in Block 2 and that
portion of 5 foot wide easement along the south side of Lot 10, Block 3, and
a right-of-way on Lum Avenue from a point 42 feet south of the centerline of
McArdle Road to its present dead end 544.34 feet south, shown by plat of

Sherwin Place Unit 1, recorded in Volume 16, Page 50, Map Records, Nueces
County, Texas and the 5 foot wide utility easements shown by said Sherwin
Place Unit 1 plat in Blocks 1 and 2 are hereby closed and abandoned provided
that applicant replat all affected properties, pay $4,224.00 to the City for
the relocation and abandonment of existing utilities, and remove all existing

SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an
efficient administration of City affairs by
aforesaid utility easements and rights-of-way,
is made and declared requiring suspension
consideration and voting upon ordinances or
meetings so that this ordinance is passed and
reading as an emergency measure this the Rn

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
