HomeMy WebLinkAbout17528 ORD - 03/16/1983AN ORDINANCE AUTHORIZING THE EXECUTION OF A THREE-YEAR LEASE AGREEMENT WITH WILLIAM SNELL FOR CHARTER BOAT SERVICE OFFICE SPACE ON THE L -HEAD. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a three-year lease with William Snell for charter boat office space on the L -Head in consideration for One Hundred Twenty Six Dollars ($126) per month, all as more fully set forth in the lease agreement, a copy of which is attached hereto and made a part hereof, marked Exhibit "A". - 17528 SEP 2 81989 CROFILME© LEASE AGREEMENT KNOW ALL MEN BY THESE PRESENTS: That this Agreement, made and entered into this the day of , 1983, A.D., by and between the Park and Recreation Department of the City of Corpus Christi, Texas, hereinafter referred to as "PARKS" and William Snell, representing Charter Boat Associates, hereinafter called "USER". WHEREAS, User has requested use of L -Head office building as depicted on attachment No. 1, for a charter boat service and sailing school office. That Parks hereby grants to said User the use of the property so described on attachment No. 1. Use permission to be granted for three (3) years, commencing on the day of approval, and subject to the terms set forth in this agreement. II. User shall pay a rental fee of One Hundred and Twenty Six ($126) dollars per month for office space of the L -Head, payable to the Collections Section, City of Corpus Christi, P.O. Box 9277, Corpus Christi, Texas, 78469, and due by the 1st of the month. III. That development and improvements will be at the expense of the User. Any alterations to existing construction, additions, or improvements shall, prior to construction, be approved in writing by Parks. In addition, any additions made by User, if not removed at any termination hereof, become the property of the City in fee simple without any other action or process of law. IV. Cost of utilities will be borne by the User. V. Security requirements will be borne by the User. VI. In User's use and enjoyment of described area, User will indemnify and save harmless the City of Corpus Christi from any neglect or misconduct on the part of the User, his agents, servants, employees, and assigns, and shall in every way hold the City harmless from same. VII. It is further understood and agreed that User shall not place, paint, or otherwise affix any signs at, on or about the property, or any part thereof, except as and when first approved in writing by Parks. Parks shall have the right at any time to require User to remove, paint, or repair any of the signs allowed. Should User not remove, paint, or repair said signs within ten (10) days of demand thereof in writing, Parks may fulfill its demands and charge the expense of same to User. VIII. Park retains the right at any time to cancel any such use privilege agreement and may cancel this agreement upon sixty (60) days written notice to User. IX. It is further understood and agreed that failure of the User to comply with any of the terms herein provided shall be authority for the City, or its agents, at the City's option, to cancel this agreement and repossess the premises described herein. In the event any legal action is undertaken by the City to collect for any damages growing out of this agreement, or to in any way enforce the provisions of the agreement, recovery shall be added to cover the expense of such legal action, in addition to any court costs. User will incur no debts or obligations on the credit of the City of Corpus Christi, Texas. The User shall be responsible to the City for the following: A. Compliance with all City health regulations and ordinances of the City of Corpus Christi as they affect the User operation. User has to bear the expenses of meeting all health regulations. B. Approved Public Liability Insurance, in the amount of $100,000/$500,000; $20,000/$100,000 Property Damage Insurance and indemnification of the City against all claims resulting from the operation of the User, his agents, servants, employees and assigns.
