AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW
SUBSECTION, 31-5.44 SETTING FORTH ZONING CLASSIFICATION
OF SAID AREA OF LAND DESCRIBED AS TRACTS 1, 2, AND 3 OUT
OF THE MARIANO L. de HERRERA GRANT, ABSTRACT NO. 606; AND
DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Pendaris
Corporation for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, March 23,
1983, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within tie
purpose of the zoning ordinance; and, that permanent zoning of "A-2"
Apartment House District on Tract 1 and "B-4" General Business District on
Tracts 2 and 3, all out of the Mariano L. de Herrera Grant, Abstract No. 606,
Nueces County, Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels or
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.44, said new
subsection to hereafter read as follows, such zoning classification of the
hereinafter described properties to be effective upon annexation:
"Section 31-5.44. The following described tracts of land shall be
zoned and classified as follows:
Tract 1
"A-2" Apartment House District on the following more particularly
described tract:
FIELDNOTES for 304,920 square feet of land out of a 205.8
acre tract of the Mariano L. de Herrera Grant, Abstract
606, as conveyed by Bess L. Hurd, et vir, to Nina G.
Stewart by deed dated August 29, 1940, and recorded in
Volume 261, Page 235, Deed Records of Nueces County,
Texas:
BEGINNING at a point on the East boundary line of East
Riverview Drive for the Southwest corner of this tract
from which corner the point of intersection of said East
boundary line with the existing North boundary line of
F.M. Road 624 bears South 00° 32' 40" East 284.15 feet;
THENCE North 00° 32' 40" East, along said East boundary
line of said East Riverview Drive, parallel to the
centerline thereof and 30.00 feet distance therefrom,
measured at right angles thereto, 155.73 feet for a
corner of this tract;
THENCE South 87° 57' 20" East, leaving said East boundary
line 100.00 feet for an inside corner of this tract;
THENCE North 00° 32' 40" East 161.43 feet for the
Northwest corner of this tract;
THENCE South 87° 57' 20" East 827.22 feet to the point of
curvature of a circular curve to the right whose radius
point bears South 02° 02' 40" West 10.00 feet and which
has a central angle of 99° 05' 53", a radius of 10.00
feet, a tangent distance of 11.73 feet and an arc length
of 17.30 feet;
THENCE, along said circular curve to the right, 17.30
feet to a point on the West boundary line of Wood River
Drive for the point of tangency and the point of
curvature of a circular curve to the left whose radius
point bears South 78° 51' 29" East 877.64 feet, a tangent
distance of 37.74 feet and an arc length of 75.44 feet;
THENCE continuing with said West boundary line along said
circular curve to the left, 75.44 feet for the point of
tangency.
THENCE South 06° 13' 00" West, along said West boundary
line of Wood River Drive, parallel to the centerline
thereof and 30.00 feet distance therefrom, measured at
right angles thereto, 296.89 feet for the Southeast
corner of this tract;
THENCE North 83° 47' 00" West, leaving said West boundary
line, 900.87 feet to the POINT OF BEGINNING.
Tract 2
"B-4" General Business District on the following more particularly
described tract:
FIELDNOTES for 5.57 acres (242,615.00 square feet) of
land proposed for B-4 zoning out of a 205.8 acre tract of
the Mariano L. de Herrera Grant, Abstract 606 as conveyed
by Bess L. Hurd, et vir, to Nina G. Stewart by deed dated
August 29, 1940, and recorded in Volume 261, Page 235,
Deed Records of Nueces County, Texas:
COMMENCING at a point on the North boundary line of
Nueces River Irrigation Park Annex No. 2, a map of which
is recorded in Volume A, Page 55, map records of Nueces
County, Texas, for the Southeast corner of Lot 1, Block
17, Wood River Unit 2, a map of which is recorded in
Volume 45, Pages 190-192, of said map records; thence
North 79° 34' 40" West, along the common boundary line of
said Nueces River Irrigation Park Annex No. 2 and Lot 1,
Block 17, 15.79 feet to a point for a corner of said Lot
1 and the Northwest corner of Nueces River Irrigation
Park Annex No. 2; thence South 10° 13' 00" West, along
the West boundary line of said Nueces River Irrigation
Park Annex No. 2, 1320.22 feet to an angle point on the
existing North boundary line of Farm -to -Market Road No.
624 (Bluntzer Road); thence North 83° 47' 00" West, along
the existing North boundary line of said F.M. 624, 30.08
feet to the Southeast corner and "Point of Beginning" of
this tract;
THENCE North 83° 47' 00" West, along the above mentioned
North line of F.M. No. 624, 572.37 feet for the point of
curvature of a curcular curve to the right which has a
central angle of 90° 00' 00", a radius of 10.00 feet, a
tangent distance of 10.00 feet and an arc length of 15.71
feet;
THENCE with said curve to the right, 15.71 feet for the
point of tangency on the East boundary line of Wood River
Drive for the Southwest end of this tract;
THENCE North 06° 13' 00" East, along the East boundary
line of Wood River Drive, 416.77 feet for the point of
curvature of another circular curve to the right which
has a central angle of 90° 00' 00", a radius of 10.00
feet, a tangent distance of 10.00 feet and an arc length
of 15.71 feet;
THENCE leaving said East boundary line of Wood River
Drive, along said curve to the right, 15.71 feet for the
point of tangency;
THENCE South 83° 47' 00" East 313.88 feet for the point
of curvature of a circular curve to the right which has a
central angle of 94° 00' 00" , a radius of 270.00 feet a
tangent distance of 289.54 feet and an arc length of
442.95 feet;
THENCE with said curve to the right, 442.95 feet for the
point of tangency;
THENCE South 00° 13' 00" West, parallel with the West
boundary line of the aforementioned Nueces River
Irrigation Park Annex No. 2 thereof and 30.00 feet
distance therefrom, measured at right angles thereto,
148.30 feet to the Point of Beginning.
Tract 3
"B-4" General Business District on the following more particularly
described tract:
FIELDNOTES for 5.73 acres (249,475.00 square feet) of
land proposed for B-4 zoning out of a 205.8 acre tract of
the Mariano L. de Herrera Grant, Abstract 606, as
conveyed by Bess L. Hurd, et vir, to Nina G. Stewart by
deed dated August 29, 1940, and recorded in Volume 261,
Page 235, Deed Records of Nueces County, Texas:
BEGINNING at the point of intersection of the North
boundary line of Farm -to -Market Road No. 624 (155.00 feet
wide) and the East boundary line of East Riverview Drive
(60.00 feet wide) for the Southwest corner of this tract
from which corner the Southwest corner of said 205.8 acre
tract bears South 00° 32' 40" West 120.59 feet;
THENCE North 00° 32' 40" East, along the East line of
East Riverview Drive, parallel to the centerline thereof
and 30.00 feet distance therefrom, measured at right
angles thereto, 284.15 feet for the Northwest corner of
this tract;
THENCE leaving the above mentioned East line, South 83°
47' 00" East 900.87 feet to a point on the West boundary
line of Wood River Drive for the Northeast corner of this
tract;
THENCE with the West boundary line of said Wood River
Drive, the following bearings and distances:
South 06° 13' 00" West 107.74 feet;
South 11° 55' 38" West 100.50 feet;
and South 06° 13' 00" West 65.00 feet for the point of
curvature of a circular curve to the right which has a
central angle of 90° 00' 00" a radius of 10.00 feet, a
tangent distance of 10.00 feet and an arc length of 15.71
feet;
THENCE with said curve to the right, 15.71 feet for the
point of tangency on the aforementioned North boundary
line of F.M. 624 for the Southeast end of this tract;
THENCE North 83° 47' 00" West, along the North boundary
line of F.M. 624, 852.78 feet to the Point of Beginning.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall tak effect upon first reading as an emergency measure this the)/

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
