AMENDING THE ZONING ORDINANCE UPON APPLICATION OF
CANDYSTICK OF CORPUS CHRISTI, INC., BY CHANGING THE
ZONING MAP IN REFERENCE TO A PORTION OF ,SHARE 3 OUT OF
THE JOHN HARNEY PARTITION, FROM "R -1B"' ONE -FAMILY
DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT;
AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Candystick of
Corpus Christi, Inc. for amendment to the zoning map of the City of Corpus
Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, April 16,
1983, at Special Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED'BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That the zoning on the hereinafter described tract of
land described as a portion of Share 3 out of the John Harney Partition,
situated in the City of Corpus Christi, Nueces County, Texas, be changed from
"R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District:
FIELDNOTES for 9.64 acres of land proposed for R-2 zoning
out of Share 3 of the John Harney partition, a map of
which is recorded in Volume 6, Page 29, map records of
Nueces Coiunty, Texas;
COMMENCING at an axle found on the Southwest subdivision
line of Nolford Place, a map of which is recorded in
Volume 42, pages 128, 129 of said map records for the
East corner of said Share 3; thence South 37° 29' 00"
West, along the Southeast line of said Share 3, 1556.00
feet to a point at its intersection with the proposed
extension of the Southerly boundary line of Yellow Oak
Avenue, shown on the recorded plat of Callicoatte Estates
17570

Unit 2, a map of which is recorded in Volume 47, pages
37, 38, 39, map records of Nueces County, Texas, for the
East corner and point of beginning of this tract;
THENCE South 37° 29' 00" West, along the Southeast line
of Share 3, 1231.18 feet to a point at its intersection
with the Easterly right-of-way line of a 40.00 foot wide
City of Corpus Christi 48 inch water line easement
recorded in Volume 634, pages 468-472, deed records of
Nueces County, Texas for the South corner of this tract;
THENCE North 18° 31' 53" West, along the Easterly
right-of-way line of said 40.00 foot wide water line
easement, 506.74 feet to a point on the proposed
extension of the Southeast boundary line of said Yellow
Oak Avenue for the West corner of this tract;
THENCE North 37° 30' 10" East, along the proposed
Southeast boundary line of Yellow Oak Avenue (60.00 feet
wide), at 112.44 feet, the South corner of Lot 12, Block
8 (School Site), said Callicoatte Estates Unit 2 bears
North 52° 29' 50" West 60.00 feet, in all a distance of
528.07 feet to the point of curvature of a circular curve
to the right which has a central angle of 89° 58' 50", a
radius of 420.00 feet, a tangent distance of 419.86 feet
and an arc length of 659.59 feet;
THENCE with said curve to the right, along the proposed
Southerly boundary line of Yellow Oak Avenue, 659.59 feet
to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1973, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall tak ffect upon first reading as an emergency measure this the

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
