HomeMy WebLinkAbout17578 ORD - 04/27/1983AN ORDINANCE CLOSING AND ABANDONING AN IRREGULARLY SHAPED PORTION OF CHIPITO STREET RIGHT-OF-WAY BEING ALONG THE SOUTH SIDE OF CHIPITO STREET RIGHT-OF-WAY, ADJACENT TO BLOCK 64, BLUFF PORTION, AND IMMEDIATELY WEST OF CABRA STREET; PROVIDING FOR REPLATTING; AND DECLARING AN EMERGENCY. WHEREAS, an irregularly shaped portion of Chipito Street right-of-way exists being along the south side of Chipito Street right-of-way, adjacent to Block 64, Bluff Portion, and immediately west of Cabra Street, as shown and described by Exhibits "A" and "B", shown by plat recorded in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way, retaining a 10 foot wide utility easement along the north side of subject tract, provided that applicant replat all affected properties. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned an irregularly shaped portion of Chipito Street right-of-way, being along the south side of Chipito Street right-of-way, adjacent to Block 64, Bluff Portion, and immediately west of Cabra Street, as shwon and described by attached Exhibits "A" and "B", retaining a 10 foot wide utility easement along the north side of subject tract, shown by plat recorded in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas, provided that applicant replat all affected properties. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by closing and abandoning the aforesaid right-of-way, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is 1 978 MICROFILMED SEP 2 81984 passed and shall take effect upon first reading as an emergency measure this the e: 'day of April, 1983.
