HomeMy WebLinkAbout17585 ORD - 05/04/1983AN ORDINANCE PROVIDING FOR PROHIBITION OF SWIMMING, USE OF SURFBOARDS, BOATS, MOTORBOATS, AND VESSELS ALONG SIDE OF BOB HALL PIER; PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Definitions. For the purposes of this ordinance, the following definitions shall apply unless the content requires a different definition: (a) Vessel - Any watercraft other than a seaplane on water, used or capable of being used for transportation on water. (b) Boat - Any vessel not more than 65 feet in length, measured from end to end over the deck, excluding sheer, and manufactured or used primarily for noncommercial use. (c) Motorboat - Any vessel propelled by machinery, whether or not the machinery is the principal source of propulsion, but shall not include a vessel which has a valid marine document issued by the Bureau of Customs of the United States Government, or any Federal agency successor. (d) Operate - Navigate or otherwise use a motorboat, vessel, or surfboard. (e) Surfboard - A flat, solid vessel made of wood, plastic, or other non -flexible material capable of supporting one or more people while floating in the water, which is not propelled by a motor and which is designed to be propelled by wave action or sail. (f) Person - An individual, partnership, firm, corporation, association or other entity. (g) Coastline - The line of mean low tide along that portion of the coast which is in direct contact with the open Gulf of Mexico. Section 2. No person shall swim, surf by the use of surfboards, operate boats, motorboats or vessels in the following designated area: Beginning at a point where the water touches the sand under Bob Hall Pier for a distance of 100 feet from the outer vertical edges of Bob Hall Pier for the entire water area around said pier as per the attached sketch as prepared by Park and Recreation dated April 28, 1983. 17:°85 SEP 2 81904 MEWED SECTION 3. Any person who violates or fails to comply with any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction of any such violation shall be fined a sum not to exceed Two Hundred Dollars ($200.00). SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. This ordinance shall be in full force and effect after publication which shall be made one time by publishing in the official newspaper of the City of Corpus Christi the caption of this ordinance stating in substance the purpose of the aforesaid ordinance.
