HomeMy WebLinkAbout17590 ORD - 05/04/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CANDY STICK - SOUTH FORK BY CHANGING THE ZONING MAP IN REFERENCE TO THREE TRACTS OUT OF LOT 15, SECTION 26, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AND LOT 1, BLOCK 2, SOUTH FORK SUBDIVISION, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT AND "R-2" MULTIPLE DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT ON TRACT 1, "B-1" NEIGHBORHOOD BUSINESS DISTRICT ON TRACT 2, AND "AB" PROFESSIONAL OFFICE DISTRICT ON TRACT 3; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Candy Stick - South Fork for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, May 4, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts of land described as three tracts out of Lot 15, Section 26, Flour Bluff' and Encinal Farm and Garden Tracts, and Lot 1, Block 2, South Fork Subdivision, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District and "R-2" Multiple Dwelling District to "B-4" General Business District on Tract 1, "B-1" Neighborhood Business •District on Tract 2, and "AB" Professional Office District on Tract 3: Tract 1 FIELDNOTES for 3.21 acres of land out of Lot 1, Block 2, South Fork Subdivision, a map of which is recorded in 17590 SEP 2 8 1984 a ,t of iLMtp Volume 47, Pages 118-121, Map Records of Nueces County, Texas: BEGINNING at a 5/8 inch iron rod set on the Southwest boundary line of The Mansions Drive (60.00 feet wide) for the East corner of said Lot 1, Block 2 and the East corner of this tract; THENCE South 29° 00' boundary line of said corner of this tract; THENCE North 61° 00' boundary line, 365.00 boundary line of Rodd this tract; 00" West, along the Southeast Lot 1, 390.52 feet to the South 00" West, leaving said Southeast feet to a point on the Southeast Field Road for the West corner of THENCE North 29° 00' 00" East, along said Southeast boundary line of Rodd Field Road, 372.88 feet to a 5/8 inch iron rod set for the point of curvature of a circular curve to the right which has a central angle of 90° 00' 00", a radius of 10.00 feet, a tangent of 10.00 feet and an arc length of 15.71 feet; THENCE, along said circular curve to the right, 15.71 feet to a 5/8 inch iron rod set on the Southwest boundary line of The Mansions Drive for the point of tangency; THENCE South 61° 00' 00" East, along said Southwest boundary line of The Mansions Drive, 280.00 feet to a 5/8 inch iron rod set for the point of curvature of a circular curve to the left which has a central angle of 11° 38' 10", a radius of 371.78 feet, a tangent distance of 37.89 feet and an arc length of 75.72 feet; THENCE along said circular curve to the left, 75.52 feet to the POINT OF BEGINNING. Tract 2 FIELDNOTES for 3.21 acres of land out of Lot 15, Section, Flour Bluff and Encinal Farm and Garden Tract, a map of which is recorded in Volume A, Pages 41-43, Map Records of Nueces County, Texas and out of Lot 1, Block 2, South Fork Subdivision, a map of which is recorded in Volume 47, Pages 118-121, of said Map Records. BEGINNING at a point on the Southeast boundary line of Rodd Field Road for the West corner of this tract from which corner a 5/8 inch iron rod set for the West corner of said Lot 1, Block 2 bears North 29° 00' 00" East 169.52 feet; THENCE North 29° 00' 00" East, along said Southeast boundary line of Rodd Field Road, at 169.52 feet pass the abovementioned West corner of Lot 1, Block 2, in all a distance of 382.89 feet to the North corner of this tract; THENCE South 61° 00' 00" East, leaving said Southeast boundary line of Rodd Field Road, 365.00 feet to a point on the Southeast boundary line of said Lot 1, Block 2, for the East corner of this tract; THENCE South 29° 00' 00" West, at 213.37 feet pass a 5/8 inch iron rod set for the South corner of said Lot 1, Block 2, in all a distance of 382.89 feet to the South corner of this tract; THENCE North 61° 00' 00" West 365.00 feet to the POINT OF BEGINNING. Tract 3 FIELDNOTES for 4.11 acres of land out of Lots 14 and 15, Section 26, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, and 43, Map Records of Nueces County, Texas: BEGINNING at a 5/8 inch iron rod set on the Southeast boundary line of Rodd Field Road for the North corner of Lot 2, Block 2, South Fork Subdivision, a map of which is recorded in Volume 47, Pages 118-121 of said Map Records and the West corner of this tract; THENCE North 29° 00' 00" East, along said Southeast boundary line of Rodd Field Road, 490.71 feet to the North corner of this tract; THENCE South 61° 00' 00" East, leaving said Southeast boundary line, 365.00 feet to the East corner of this tract; THENCE South 29° 00' 00" West 490.71 feet to a point on the Northeast boundary of said Lot 2, Block 2, for the South corner of this tract; THENCE North 61° 00' 00" West, along said Northeast boundary line, 365.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of ATTEST: 1274,1 , 19 #Ie `retary APP D: p DAY OF J.
