HomeMy WebLinkAbout17597 ORD - 05/11/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW SUBSECTION, 31-5.51 SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LSD DESCRIBED AS TRACTS 1, 2, 3, 4, 5, AND 6 OUT OF SECTION 26, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of County Creek Corporation for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, May 11, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "R-2" Multiple Dwelling Dstirct on Tracts 1, 2, and 6, "R -1C" One -family Dwelling District on Tracts 3 and 5, and "R -1B" One -family Dwelling District on Tract 4, all out of Section 26, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus'Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: SEP 2 81994 NNCRDFILMED NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.51, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described properties to be effective upon annexation: "Section 31-5.51. The following described tracts of land shall be zoned and classified as follows: Tract 1 "R-2" Multiple Dwelling District on the following more particularly described tract: FIELDNOTES for proposed R-2 zoning of 6.2 acres of land, more or less, out of Lot 3, Section 26, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, and 43, Map Records of Nueces County, Texas: BEGINNING at the point of intersection of the centerline of The Mansions Drive (60.00 feet wide) with the Southeast subdivision line of South Fork Subdivision, a map of which is recorded in Volume 47, Pages 118-121 of said Map Records for the North corner of this tract from which corner a 5/8 inch iron rod set for the East corner of Lot 1, Block 3, of said South Fork Subdivision bears South 28° 45' 35" West 30.00 feet; THENCE South 61° 00' 00" East, leaving said Southeast subdivision line, 288.91 feet, more or less, to a corner of this tract; THENCE North 58° 56' 10" East 331.42 feet, more or less, to a corner of this tract; THENCE South 31° 03' 50" East 135.00 feet, more or less, to the East corner of this tract; THENCE South 58° 56' 10" West 450.00 feet, more or less, to a corner of this tract; THENCE North 61° 14' 25" West 71.00 feet, more or less, to an inside corner of this tract; THENCE South 28° 45' 35" West 545.00 feet, more or less, to a corner of this tract; THENCE North 61° 14' 25" West, 165.00 feet, more or less, to an inside corner of this tract; THENCE South 28° 45' 35" West 125.00 feet, more or less, to a point on the Southwest boundary line of said Lot 3, Section 26 for the South corner of this tract; THENCE North 60° 58' 20" West, along said Southwest boundary line of Lot 3, at 106.24 feet, more or less, pass a 3/4 inch iron rod found in concrete for reference, in all a distance of 110.00 feet, more or less, to a 5/8 inch iron rod set for an angle point in the Southeast boundary line of South Fork Subdivision, the West corner of said Lot 3 and the West corner of this tract; THENCE North 28° 45' 35" East, along said Southeast subdivision line, 840.82 feet, more or less, to the POINT OF BEGINNING. Tract 2 "R-2" Multiple Dwelling District on the following more particularly described tract: FIELDNOTES for proposed R-2 zoning of 12.9 acres, more or less, of land out of Lots 5A, 6 & 7, Section 26, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, and 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Northeast boundary line of said Lot 7 for the East corner of this tract from which corner the East corner of said Lot 7 bears South 61° 04' 40" East 200.00 feet, more or less; THENCE South 43° 55' 20" West, leaving said Northeast boundary line, same being the Northeast section line of said Section 26, 569.40 feet, more or less, to the South corner of this tract; THENCE North 61° 04' 40" West 875.26 feet, more or less, to the West corner of this tract; THENCE North 13° 55' 20" East 569.40 feet, more or less, to a point on the aforementioned Northeast boundary line of Lot 5A for the North corner of this tract; THENCE South 61° 04' 40" East, along said Northeast boundary line, 1,170.00 feet, more or less, to the Point of Beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of J')') (� � , 19 p 3 .
