AN ORDINANCE
AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW
SUBSECTION, 31-5.52 SETTING FORTH ZONING CLASSIFICATION
OF SAID AREA OF LAND DESCRIBED AS TRACTS 1 AND 2 ON
MUSTANG ISLAND OUT OF THE NORTH 280 ACRES OF THE WILLIAM
BRYAN SURVEY; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Devco
International, Inc. for amendment to the zoning map of the City of Corpus
Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, May 18,
1983, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-2" Bayfront
Business District on Tracts 1 and 2 on Mustang Island out of the North 280
acres of the William Bryan Survey, Nueces County, Texas, more fully described
hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels or
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.52, said new
subsection to hereafter read as follows, such zoning classification of the
hereinafter described properties to be effective upon annexation:
"Section 31-5.52. The following described tracts of land shall be
zoned and classified as follows:
Tract 1
"B-2" Bayfront Business District on the following more particularly
described tract:
FIELDNOTES for proposed B-2 zoning of 2.76 acres, more or
less, of land on Mustang Island out of the area between
the West boundary line of the North 280 acres of the
William Bryan Survey, L.S. 64 and the East boundary line
of Park Road No. 53, Nueces County, Texas:
BEGINNING at a point on the East boundary line of Park
Road No. 53 for the Southwest corner of this tract from
which corner a 1 inch iron rod set at the intersection of
said East boundary line with the Northwesterly extension
of the South boundary line of the North 280 acres of the
William Bryan Survey, L.S. 64 bears South 30° 19' 00"
West 140.04 feet, more or less;
THENCE North 30° 19' 00" East, along the East boundary
line of Park Road No. 53, parallel to the centerline
thereof and 200.00 feet, more or less, distant therefrom,
measured at right angles thereto, 400.00 feet, more or
less, to the Northwest corner of this tract;
THENCE South 58° 22' 00" East, leaving said East boundary
line, 300.00 feet more or less to the Northeast corner of
this tract;
THENCE South 30° 19' 00" West 400.00 feet, more or less,
to the Southeast corner of this tract;
THENCE North 58° 22' 00" West 400.00 feet, more or less,
to the POINT OF BEGINNING.
Tract 2
"B-2" Bayfront Business District on the following more particularly
described tract:
FIELDNOTES for proposed B-2 zoning of 64.84 acres of
land, more or less, on Mustang Island, being out of the
North 280 acres of the William Bryan Survey, L.S 64 and
the area between the West boundary line of said 280 acre
tract and the East boundary of Park Road No. 53, Nueces
County, Texas:

BEGINNING at a 1 inch iron rod set at the intersection of
the East boundary line of Park Road No. 53 with the
Northwesterly extension of the South boundary of the
North 280 acres of the William Bryan Survey, L.S 64 for
the Southwest corner of this tract, from which corner a
60 penney nail over a 5/8 inch iron rod found in the
centerline of the Park Road No. 53 bears North 58° 22'
00" West 200.05 feet, more or less;
THENCE North 30° 19' 00" East, along the East boundary
line Park Road No. 53, 140.04 feet, more or less, for a
corner of this tract;
THENCE South 58° 22' 00" East, leaving said East boundary
line, 1812.00 feet more or less, for an inside corner of
this tract;
THENCE North 51° 00' 00" East 895.00 feet, more or less,
for a corner of this tract;
THENCE North 25° 47' 50" East 100.00 feet, more or less,
for a corner of this tract;
THENCE North 11° 00' 00" East 975.00 feet, more or less,
for the Northwest corner of this tract;
THENCE South 58° 22' 00" East 1358.00 feet, more or less,
to a point on the line of mean high tide (elevation 1.64
feet above mean sea level) of the Gulf of Mexico for the
Northeast corner of this tract;
THENCE, along said line of mean high tide as follows:
South 23° 26' 40" West 409.30 feet;
South 25° 40' 00" West 600.38 feet
South 27° 08' 05" West 496.75 feet and
South 28° 45' 55" West 503.16 feet to the Southeast
corner of this Tract;
Thence North 58° 22' 00" West, 3302.79 feet to the POINT
OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the 4

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
