HomeMy WebLinkAbout17610 ORD - 05/25/1983AN ORDINANCE AMENDING CHAPTER 49, CORPUS CHRISTI CODE, STREETS AND SIDEWALKS, SECTION 49-21, TO PROVIDE FOR A POLICY OF STREET PAVING ASSESSMENTS IN COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 49, Corpus Christi Code, Streets and Sidewalks, Section 49-21, is hereby amended by adding Subsection II to Section C to read as follows: II. The following assessment policy will apply to street assessment projects funded wholly or in part by Community Development Block Grant Funds through the Department of Housing and Urban Development. 1. Property being used for one or two family residential dwellings will be assessed at the special residential rate described in Section C I herein. 2. Low-income residents who own and occupy property being assessed at the special residential rate as described in Section C I herein will qualify for a non-interest, deferred payment loan as long as they own and occupy the property. At the time the property is sold the loan will be paid to the City in full without interest or penalty. Eligibility for delayed assessment payment will be determined by the City upon application by the property owner. Income criteria established by the Community Development Act of 1974 and subsequent amendments for the Section Eight program participation will be utilized in establishing eligibility for qualification as a low income resident. 3. The absentee owners of residential property (1 or 2 family dwellings) will be offered low interest Community Development Fund loans for the purpose of paying street assessments providing the property is occupied by low income tenants. These loans will be administered by the City. 4. Commercially used property and property other than one or two family residential property not qualifying for low income provisions will be assessed in accordance with the other provisions of this ordinance. SECTION 2.
