HomeMy WebLinkAbout17619 ORD - 06/01/1983AN ORDINANCE CLOSING AND ABANDONING THAT 25 FOOT WIDE PORTION OF GOLLIHAR ROAD RIGHT-OF-WAY SHOWN BY PLAT OF LOTS 1 AND 2, LYLES SUBDIVISION ANNEX; PROVIDING FOR REPLATTING; AND DECLARING AN EMERGENCY. WHEREAS, a 25 foot wide portion of Gollihar Road right-of-way exists as shown by plat of Lots 1 and 2, Lyles Subdivision Annex, recorded in Volume 27, Page 84, Map Records, Nueces County, Texas, and further described by metes and bounds below from a point 40 feet easterly from the centerline of Greenwood Drive to its dead end 325 feet eastward; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way, retaining the full width as utility easement and providing the right-of-way revert to the owners of said Lots 1 and 2, Lyles Subdivision Annex, provided that applicant replat all affected properties. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned a 25 foot wide portion of Gollihar Road right-of-way shown by plat of Lots 1 and 2, Lyles Subdivision Annex, recorded in Volume 27, Page 84, Map Records, Nueces County, Texas, and further described by metes and bounds below, from a point 40 feet easterly from the centerline of Greenwood Drive to its dead end 325 feet eastward, retaining the full width as utility easement and providing the right-of-way revert to the owners of said Lots 1 and 2, Lyles Subdivision Annex, provided that applicant replat all affected properties. DESCRIPTION of a strip of land adjoining Lots 1 and 2, Lyles Subdivision Annex, as shown on map recorded in Volume 27, Page 84, Map Records, Nueces County, Texas, described as follows: BEGINNING at the most westerly corner of said Lot 2; THENCE, along the southwesterly line of said Lots, South 61° 40' 00" East, 325.00 feet to the beginning of a curve concave to the north; THENCE, along said curve, having a radius of 10.00 feet, through a central angle of 90° 20' 00", 15.71 feet to a point of cusp; THENCE, along a prolongation of the southeasterly line of said Lot 1, South 28° 20' 00" West, 35.00 feet to a point on the centerline of Gollihar Road, as shown on said map; SEP 2 8 1984 17619 MICROFILMED THENCE, along said centerline, North 61° 40' 00" West, 335.00 feet; THENCE, North 28° 20' 00" East, 25.00 feet to the POINT OF BEGINNING. CONTAINING 0.193 acres more or less. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by closing and abandoning the aforesaid right-of-way, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the ^' day of June, 1983.
