HomeMy WebLinkAbout17622 ORD - 06/01/1983AN ORDINANCE CLOSING LEOPARD STREET BETWEEN McKINZIE ROAD AND PEACHTREE STREET FROM 9:00 A.M. UNTIL 6:00 P.M. SUNDAY, JUNE 26, 1983; PERMITTING THE NORTHWEST BUSINESS ASSOCIATION THE USE OF THE STREET, MEDIAN AND ROADWAY RIGHT-OF-WAY TO HOST A NORTHWEST SUMMER FEST; AUTHORIZING EXECUTION OF ATTACHED APPLICATION/PERMIT; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Northwest Business Association of Corpus Christi, Texas, has formulated plans for a Northwest Summer Fest to be held on Sunday, June 26, 1983; and WHEREAS, the purpose of said Summer Fest is to raise funds and to provide public entertainment and refreshments; and WHEREAS, the proceeds from this event will be used for community and civic projects, primarily in the Northwest area of the City; and WHEREAS, the Northwest Business Association in order to host said event, has requested that from 9:00 a.m. until 6:00 p.m. Sunday, June 26, 1983, Leopard Street between McKinzie Road and Peachtree Street be closed to vehicular traffic; and WHEREAS, business and community leaders in the northwest part of Corpus Christi will participate in the Summer Fest and have endorsed it; and WHEREAS, the City Council finds that the planned Northwest Summer Fest will be in the interest of the public welfare; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That vehicular traffic be banned on Leopard Street between McKinzie Road and Peachtree Street from 9:00 a.m. until 6:00 p.m. Sunday, June 26, 1983, so that the Northwest Business Association can sponsor a Northwest Summer Fest and that said area be barricaded to traffic. It is directed that said area be barricaded so as to allow emergency vehicles such as fire, police, and ambulance vehicles, to enter said area in case of emergency. It is further provided that abutting property occupants and vehicles of the City or Utility Companies be permitted to enter said area in case of an emergency. SECTION 2. That in maintaining the street and public areas closed by this ordinance, the provisions of an application/permit executed by the SEP 2 81984 ILCRUFILMED 17622 Event Sponsor and the City Manager shall be observed; a copy of said application/permit is attached hereto and made a part of this ordinance. SECTION 3. The City Manager is authorized to execute the attached application/permit for and on behalf of the City, which shall be filed for record in the office of the City Secretary. SECTION 4. The provisions of this ordinance relating to closing of the aforementioned street and public areas are effective for the period beginning at 9:00 a.m. through 6:00 p.m. Sunday, June 26, 1983. The other provisions of this ordinance are effective from and after the date of publication of the caption of this ordinance in the official publication of the City one time. However, no part of this ordinance shall be effective until the City Manager and the authorized representative of the sponsoring organization execute the aforementioned application/permit, and the Certification of Insurance is approved and filed. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 6. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 7. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to approve the closing of the aforementioned street so that plans for the Northwest Summer Fest can be formulated, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the/Qt day of June, 1983. ATTEST: MAYOR Ci Secretary THE CIT APPROVED: I,7// DAY OF JUNE, 1983 J. isAy cock, Ci'orney CORPUS CHRISTI, TEXAS THE STATE OF TEXAS § COUNTY OF NUECES § APPLICATION/PERMIT KNOW ALL MEN BY THESE PRESENTS: Application The Northwest Business Association of Corpus Christi, Texas, in order to sponsor the Northwest Summer Fest on Sunday, June 26, 1983, hereby makes application, acting by and through Ms. Connie Trevino and Mr. Jerry Allen, Event Co -Chairpersons, representing the Northwest Business Association, to the City of Corpus Christi, acting by and through Edward A. Martin, its duly authorized representative, for the closing of Leopard Street to vehicular traffic between McKinzie Road and Peachtree Street from 9:00 a.m. until 6:00 p.m. on Sunday, June 26, 1983, and granting the exclusive use of the street and public area for said event activities. In consideration of the closing of said street and the use of said street and public areas, the sponsoring organization hereby agrees to comply with the following regulations: 1. Admission to the event shall be free to the public. 2. All profits derived from the event shall be used for civic projects or charitable causes. 3. Insurance shall be provided having a minimum total liability coverage of $500,000 and shall name the City as additional insured. 4. An indemnification agreement holding the City harmless from any and all claims resulting from said event shall be executed. 5. Provide sufficient barricades and place them in the street. in--' accordance with a plan approved by the City Traffic Engineer. `4 6. Obtain approval from 100 percent of all abutting property owners on Leopard Street within the street closure. 7. Provide adequate number of restrooms to accommodate the anticipated public. 8. Obtain the appropriate alcohol and food permits required by the State and Local Authorities, at least two weeks prior to the event. 9. Construct booths, stages, displays, electrical services and plumbing in compliance with City Code requirements. The final layout of booths shall be approved by the Director of Park and Recreation. 10. Provide for potable water within the event site. 11. Provide First Aid stations. 12. Provide continuous cleaning of the site during the event and return it to pre -event condition after event ends. 13. Restore any damaged City property promptly after event ends. 14. Coordinate all phases of event with appropriate City departments to insure a safe and successful event. 15. Prevent vehicles from parking on grass areas within street right-of-way. 16. No paint or markings shall be applied to the street surface and the pavement shall not be cut, trenched or otherwise disturbed. 17. All City Noise Abatement Ordinances shall be complied with. 18. Emergency vehicles, public utility vehicles and vehicles belonging to abutting property owners shall be permitted to enter the site in case of an emergency. 19. To reimburse the City the cost of providing six (6) uniformed police officers to control and direct traffic around the street detours. If the sponsor arranges to obtain said peace officers from the County Sheriff's office or a County Constable's office, there will be no such charge by the City. 20. To reimburse the City the full cost of cleanup, i.e., hosing down, street sweeping and litter pickup; however, it is understood there will be no such charge if the sponsor performs these tasks when the event ends. To close Leopard Street between McKinzie Road and Peachtree Street to vehicular traffic, during those periods specified herein. 2. To allow the use of the street, median and roadway right-of-way for the activities of the Northwest Summer Fest. 3.
