AMENDING ORDINANCE NO. 7725 PERTAINING TO CROSS DRAINAGE
CONSTRUCTION AGREEMENTS BETWEEN THE CITY OF CORPUS
CHRISTI AND THE STATE OF TEXAS TO INCLUDE A FOURTH STORM
DRAINAGE OUTFALL KNOWN AS THE HUNTER DRAINAGE CHANNEL;
AMENDING THE MAINTENANCE PROVISIONS OF SAID ORDINANCE;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Ordinance No. 7725, passed September 21, 1965,
pertaining to Cross Drainage Construction Agreements between the City of
Corpus Christi and the State of Texas be amended whereby a fourth storm
drainage outfall known as the Hunter Drainage Channel and located immediately
west of Hunter Road between I.H. 37 and Up River Road is to be included in
said Cross Drainage Agreements to the extent that the City will indemnify the
State from diverted drainage water as described in said Cross Drainage
Agreements for the Hunter Channel in the same fashion as the three other
referenced drainageways between Corn Products Road and Rand Morgan Road.
SECTION 2. That the aforementioned Ordinance is further amended
whereby the City will assume maintenance of the Hunter Channel when diverted
waters enter said channel under the same maintenance provisions as are
provided for in said Cross Drainage Agreements and whereby the City further
assures the State of Texas that it will be responsible to enlarge or increase
the capacity of the existing 7 foot by 7 foot drainage structure under I.H.
37 at the Hunter Channel only if it is shown by the State of Texas that any
such additional drainage waters described as diverted drainage waters cause
flooding of I.H. 37 at the 7 foot by 7 foot drainage structure.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the immediate
need for efficient and effective administration of City affairs by amending
the aforementioned cross -drainage construction agreements, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular

meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the o day of June, 1983.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
