AMENDING THE CODE OF ORDINANCES, BY AMENDING ARTICLE II,
MARINA SECTION, CHAPTER 12, BAYS, BOATS AND WATERWAYS,
SECTION 12-79, SLIP RENTAL CONTRACT BY ADDING
SUB -PARAGRAPH (h) TITLED REBATE FOR TRANSIENT CRAFT USAGE
OF CONTRACTED SLIPS WHILE VACANT, ESTABLISHING A REBATE
BASED UPON A PRO -RATA SHARE TO BE RETURNED TO THE
CONTRACT SLIP TENANT OR SUB -LEASE TENANT WHEN THEIR SLIP
IS RENTED TO A TRANSIENT CRAFT, AND ESTABLISHING A
REQUIREMENT THAT SLIP TENANTS, INCLUDING SUB -LEASE
TENANTS, NOTIFY THE MARINA OFFICE OF VACANCY, AS A
CRITERIA FOR REBATE, SPECIFICALLY AMENDING ORDINANCE NO.
13462, SECTION 1; PROVIDING FOR AN EFFECTIVE DATE; AND
PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Code of Ordinances is hereby amended by
amending Article II, Marina Section 12-79, Slip Rental Contract, by adding
sub -paragraph (h) titled Rebate for Transient Craft Usage of Contracted Slips
While Vacant, establishing a rebate based upon a pro -rata share of the
lease's monthly slip charge to be returned to the contract slip tenant or
sub -lease tenant when their slip is rented to a transient craft, and
establishing a requirement that slip tenants including sub -lease tenants,
must notify the Marina office of vacancy, specifically amending Ordinance No.
13462, Section 1, as amended, passed and approved by the City Council of
Corpus Christi, Texas, on November 3, 1976, add the following sub -paragraph:
(h) Rebate for transient craft usage of contracted slips
while vacant - a rebate based upon a pro -rata share of
the lease's monthly slip charge shall be returned to the
contract slip tenant or sub -lease tenant when their slip'
is rented to a transient craft, provided that the slip
tenant or sub -lease tenant has notified the Marina
Superintendent that his slip will be vacant. The slip
tenant or sub -lease tenant must notify the Marina
Superintendent of the said vacancy in order to receive
his pro -rata share rebate.
SECTION 2. All ordinances or part of ordinance in conflict
herewith are hereby repealed to the extent of such conflicts.
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance for it is the definite intent of the City
Council that every section, paragraph, subdivision, clause, phrase, word, or
provision, hereof be given full force and effect for its purpose.
