HomeMy WebLinkAbout17650 ORD - 06/15/1983AN ORDINANCE CLOSING AND ABANDONING THAT 40 FOOT WIDE PORTION OF PUBLIC RIGHT-OF-WAY, BEING AN EXTENSION OF SARATOGA BOULEVARD EAST OF RODD FIELD ROAD, SHOWN AND DEDICATED BY PLAT OF FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS FROM A PREVIOUSLY CLOSED SECTION OF 40 FOOT WIDE RIGHT-OF-WAY AT ITS WEST END, TO A POINT APPROXIMATELY 817 FEET EASTWARD,; PROVIDING FOR REPLATTING; AND DECLARING AN EMERGENCY. WHEREAS, a 40 foot wide portion of right-of-way, being an extension of Saratoga Boulevard east of Rodd Field Road, exists as shown and dedicated by plat of of Flour Bluff and Encinal Farm and Garden Tracts, recorded in Volume A, Pages 41-43, Map Records, Nueces County, Texas, from a previously closed section of 40 -foot wide right-of-way (Ordinance No. 17098) at its west end, to a point approximately 817 feet eastward, and further described by metes and bounds; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way, provided that applicant replat all affected properties. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned a 40 foot wide portion of public right-of-way, being an extension of Saratoga Boulevard east of Rodd Field Road, shown and dedicated by plat of Flour Bluff and Encinal Farm and Garden Tracts, recorded in Volume A, Pages 41-43, Map Records, Nueces County, Texas, from a previously closed section of 40 -foot wide right-of-way (Ordinance No. 17098) at its west end, to a point approximately 817 feet eastward, and further described by metes and bounds below, provided that applicant replat all affected properties. BEING a 40 foot wide by approximately 817 foot long portion of street right-of-way out of Lots 29 and 30, Section 27, and Lots 3 and 4, Section 26, and dedicated by plat of Flour Bluff & Encinal Farm & Garden Tracts, recorded in Volume A, Pages 41-43, Map Records, Nueces County, Texas, and being an extension of Saratoga Boulevard east of Rodd Field Road and further described by metes and bounds as follows: BEGINNING at a point being the north corner of Lot 3, Section 26, and the west corner of Lot 30, Section 27, both shown by above mentioned plat and being a point on the centerline of said 40 foot wide right-of-way; 2,S,15%4 mooII.��� 17650 THENCE North 29° East 20.00 feet to a point for the north corner of this tract; THENCE South 61° 04' 40" East at 660 feet pass the common lot line of said Lots 29 and 30 in all a distance of 816.97 feet to a point on the arc of a circular curve whose radius equals 460.00 feet, central angle equals 12° 38' 08", tangent equals 50.93 feet; THENCE in a westerly direction along the arc of said curve to the left whose initial tangent bearing equals North 78° 02' 07", a distance of 101.44 feet to a point; THENCE North 61° 04' 40" West at 69.76 feet pass the common lot line of Lots 3 and 4, Section 26, in all a distance of 729.76 feet to a point for the west corner of this tract; THENCE North 29° East 20.00 feet to the POINT OF BEGINNING and containing 0.710 acres more or less. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by closing and abandoning the aforesaid right-of-way, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the ay of June, 1983.
