CLOSING AND ABANDONING SECOND STREET BETWEEN MORGAN
AVENUE AND ELIZABETH STREET, SHOWN AND DEDICATED BY PLAT
OF OCEAN VIEW SUBDIVISION; CLOSING AND ABANDONING THE 15
FOOT WIDE ALLEY IN BLOCK II, OCEAN VIEW SUBDIVISION FROM
ELIZABETH STREET TO THE NORTH LOT LINES OF LOTS 5 AND 18,
OCEAN VIEW ADDITION; CLOSING AND ABANDONING THE 20 FOOT
WIDE EAST/WEST ALLEY ALONG THE SOUTH LOT LINE OF LOT 4,
OCEAN VIEW ADDITION; PROVIDING FOR REPLATTING; AND
DECLARING AN EMERGENCY.
WHEREAS, a right-of-way exists on Second Street between Morgan
Avenue and Elizabeth Street as shown by plat of Ocean View Subdivision,
recorded in Volume 1, Page 11, Map Records, Nueces County, Texas, there
exist a 15 foot wide alley in Block II, Ocean View Subdivision from Elizabeth
Street to the north lot lines of Lots 5 and 18, Ocean View Addition, and a
20 -foot wide east/west alley along the south lot line of Lot 4, Ocean View
Addition; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said right-of-way and
alleys, subject to certain conditions more fully described in Sections 1 and
2 hereof:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned a
right-of-way on Second Street between Morgan Avenue and Elizabeth Street as
shown by plat of Ocean View Subdivision recorded in Volume 1, Page 11, Map
Records, Nueces County, Texas; providing that the west 30 feet of
right-of-way be retained as utility easement, that a 20 foot wide paved fire
lane be provided out of the north 200 feet of existing Second Street
right-of-way.
SECTION 2. That there is hereby closed and abandoned the 15 foot
wide alley in Block II, Ocean View Subdivision, from Elizabeth Street
northerly to the north lot lines of Lots 5 and 18, Ocean View Addition,
retaining the full length and width as utility easement; that the 20 foot
wide east/west alley along the south lot line of Lot 4, Ocean View Addition,
as dedicated by Ordinance No. 8884, be closed and abandoned, and retaining a
20 foot wide fire lane along this alley from Second Street to 140 feet

westerly towards Third Street; providing that applicant replat its property
in the west half of Block I and all properties in Block II, including Lots 1
through 4 and 17 through 22, all in Ocean View Subdivision; providing that
the Second Street closure not be effective until the City completes its 1983
reconstruction program in Elizabeth Street from Ocean Drive to Third Street;
providing that the Second Street right-of-way revert to the adjacent property
owners, divided equally along centerline.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid right-of-way, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
