HomeMy WebLinkAbout17664 ORD - 06/22/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF RESOURCE CAPITAL COMPANY, TRUSTEE, BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1 AND 2 BEING PORTIONS OUT OF LOTS 7 AND 8, SECTION 19, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "F -R" FARM -RURAL DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT ON TRACT 1, AND "B-4" GENERAL BUSINESS DISTRICT ON TRACT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Resource Capital Company for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, June 22, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts of land described as portions out of Lots 7 and 8, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "F -R" Farm -Rural District to "A-1" Apartment House District on Tract 1, and "6-4" General Business District on Tract 2: Tract 1 FIELDNOTES for 13.29 acres of land, more or less, proposed for re -zoning out of the Southwest one-half of Lots 7 and 8, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: SEP 2 8 1984 17664 MICROFILME11. see BEGINNING at a 1 inch iron pipe found on the Southeast subdivision line of Sunshine Acres, a map of which is recorded in Volume 11, Page 6, Map Records of Nueces County, Texas, for the North corner of Lot 10, West corner of Lot 7, Section 19, and the West corner of this tract; THENCE North 29° 00' 00" East, along the Southeast subdivision line of said Sunshine Acres and the Northwest boundary line of said Lot 7, 659.97 feet, more or less, to a point for the North corner of the Southwest one-half of said Lot 7 and the North corner of this tract; THENCE South 60° 57' 30" East, along the Northeast boundary line of the Southwest 1/2 of Lots 7 and 8, 870.92 feet, more or less, to a point for the East corner of this tract; THENCE South 28° 27' 55" West 660.00 feet, more or less, to a point on the common boundary line of Lots 8 and 9, Section 19, for the South corner of this tract; THENCE North 60° 57' 30" West, along the common boundary line of said Lots 8 and 9 and also the common boundary line of Lots 7 and 10, 877.08 feet to the POINT OF BEGINNING. Tract 2 FIELDNOTES for 6.06 acres of land, more or less, proposed for re -zoning out of the Southwest one-half of Lot 8, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: COMMENCING at a 5/8 inch iron set on the Northwest boundary line of Rodd Field Road (State Highway No. 357) for the East corner of Lot 20, Block 3, Windbrook, a map of which is recorded in Volume 48, Page 84, 85, Map Records of Nueces County, Texas; Thence North 28° 27' 55" East, along the Northwest line of Rodd Field Road, parallel with the centerline thereof and 60.00 feet distant therefrom, measured at right angles thereto, 677.50 feet to its intersection with the Southwest boundary line of said Lot 8, Northeast boundary line of Lot 9, Section 19 for the South corner and POINT OF BEGINNING of this tract; THENCE North 60° 57' 30" West, along the common boundary line of said Lots 8 and 9, 400.00 feet to a point for the West corner of this tract; THENCE North 28° 27' 55" East 660.00 feet, more or less, to a point on the Northeast boundary line of the Southwest one-half of said Lot 8 for the North corner of this tract; THENCE South 60° 57' 30" East, along the Northeast line of the Southwest one-half of said Lot 8, 400.00 feet to a point on the aforementioned Northwest boundary line of Rodd Field Road and for the East corner of this tract; THENCE South 28° 27' 55" West, along the Northwest line of said Rodd Field Road, parallel with the centerline thereof and 60.00 feet distant therefrom, measured at right angles thereto, 660.00 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take a f-ct upon first reading as an emergency measure this the 41/ day of /��4 , 19 ATTEST: y ecretary MAYOR THE CITY OF'tORPUS CHRISTI, TEXAS AROD: A B CE RU DAY OF �AYCOCK, Corpus Christi, Tex 22i day of _a� , 1983 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
