SOUTH
CLOSING AND ABANDONING THE 15 F90f WIDE UTILITY EASEMENT
ON THE COMMON LOT LINE BETW LOTS 1 AND 2, BLOCK 8,
SHELL ROAD POULTRY ACRES, THE 7.5 FOOT WIDE UTILITY
EASEMENT ALONG THE NeBOUNDARY OF SAID LOT 2, TO A
POINT 7.5 FFET FROM THE EASTERNMOST CORNER OF SAID LOT 2;
PROVIDING FOR REPLATTING; AND DECLARING AN EMERGENCY.
WHEREAS, a 15 foot wide utility easement exists on the common lot
line between Lots 1 and 2, Block 8, Shell Road Poultry Acres, shown by plat
recorded in Volume 40, Page 38, Map Records, Nueces County, Tas, and there
exists a 7.5 foot wide utility easement along the n°Dnr boundary of said
Lot 2, to a point 7.5 feet from the easternmost corner of said Lot 2; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said utility easements,
provided that applicant replat all affected properties.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. .That there is hereby closed and abandoned the 15 foot
wide utility easement on the common lot line between Lots 1 and 2, Block 8,
Shell Road Poultry Acres, shown by plat recorded in Volume 40, Page 38, Map
Records, Nueces County, Texas, and there is hereby closed and abandoned the
7.5 foot wide utility easement along the northeast boundary of said Lot 2, to
a point 7.5 feet from the easternmost corner of said Lot 2, provided that
applicant replat all affected properties.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need
efficient administration of City affairs by closing and abandoning
aforesaid utility easements, such finding of an emergency is made
declared requiring suspension of the Charter rule as to consideration
for

ordinance is passed and shall take effect upon first reading as an emergency

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
