HomeMy WebLinkAbout17667 ORD - 06/22/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF HANK OLSEN BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS A, B, AND C BEING PORTIONS OUT OF LOT 6, SECTION 8, BOHEMIAN COLONY LANDS, FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "8-4" GENERAL BUSINESS DISTRICT ON TRACT A, "A-2" APARTMENT HOUSE DISTRICT ON TRACT B, AND "R -1C" ONE -FAMILY DWELLING DISTRICT ON TRACT C; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Hank Olsen for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, June 22, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts of land described as portions out of Lot 6, Section 8, Bohemian Colony Lands, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "I-2" Light Industrial District to "B-4" General Business District on Tract A, "A-2" Apartment House District on Tract B, and "R -1C" One -family Dwelling District on Tract C: Tract A Tract A being 5.58 acres of land, more or less, out of Lot 6, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas, and said Tract A being more particularly described by metes and bounds as follows: 1.7667 SEP 281984 MICROFILMED do Beginning at the northwest corner of this tract, said corner being on the east right-of-way line of State Highway 286 also known as Ayers Street and Chapman Ranch Road and said corner also lying on the boundary line between Lot 6 and Lot 7, Section 8, of the Bohemian Colony Lands; Thence S 61° 30' 00" E along the north boundary of this tract also being the south boundary of said Lot 7 and the north boundary of said Lot 6, 343.89 feet, to the northeast corner of this tract; THENCE 5 28° 30' 00" W along the east boundary of this tract, 700.48 feet, to the southeast corner of this tract; THENCE N 61° 30' 00" W along the south boundary of this tract, 350.00 feet, to the southwest corner of this tract, said corner being on the east R.O.W. line of State Highway 286; Thence N 29° 00' 00" E along the west boundary of this tract, the same being the east R.O.W. line of said State Highway 286, 700.50 feet, to the point of beginning and containing 5.58 acres of land, more or less. Tract B Tract B being 9.65 acres of land, more or less, out of Lot 6, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas, and said Tract B being more particularly described by metes and bounds as follows: Beginning at the southwest corner of this tract, said corner being on the east right-of-way line of State Highway 286 also known as Ayers Street and Chapman Ranch Road and said corner being on the boundary line between Lot 6, Section 8, Bohemian Colony Lands, and Lot 5, Section 8, Bohemian Colony Lands; Thence N 29° 00' 00" E, along the west boundary of this tract also being the east R.O.W. line of said State Highway 286, 620.50 feet, to the northwest corner of this tract; Thence leaving said R.O.W. line S 61° 30' 00" E along the north boundary of this tract, 674.59 feet, to the northeast corner of this tract; Thence S 28° 30' 00" W along the east boundary of this tract, 620.47 feet, to the southeast corner of this tract, said southeast corner being on the south boundary of said Lot 6, the same being the north boundary of said Lot 5, Section 8, Bohemian Colony Lands; Thence N 61° 30' 00" W along the south boundary of this tract, the same being the common boundary between Lot 6 and Lot 5, 680.00 feet to the point of beginning and containing 9.65 acres of land, more or less. Tract C Tract C being 61.58 acres of land, more or less, out of Lot 6, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas, and said Tract C being more particularly described by metes and bounds as follows: Beginning at the southeast corner of this tract, said corner being on the west boundary of tract conveyed to the City of Corpus Christi and recorded in Volume 1224, Page 479, Deed Records of Nueces County, Texas, and said corner also being on the boundary line between Lot 6, Section 8, Bohemian Colony Lands, and Lot 5, Section 8, Bohemian Colony Lands; Thence N 61° 30' 00" W along the south boundary of this tract, the same being the common boundary between said Lots 6 and 5, 1853.44 feet to the southwest corner of this tract; Thence N 28° 30' 00" E along the west boundary of this tract, 620.47 feet, to an inside corner of this tract; Thence N 61° 30' 00" W, 324.59 feet, to a corner of this tract; Thence N 28° 30' 00" E, 700.48 feet, to the northwest corner of this tract, said corner being on the south boundary line of Lot 7, Section 8, Bohemian Colony Lands, the same being the north boundary of Lot 6, Section 8, Bohemian Colony Lands; Thence S 61° 30' 00" E along the north boundary of this tract, the same being the south boundary of said Lot 7 and the north boundary of said Lot 6, 2188.80 feet to the northeast corner of this tract, said northeast corner being at the intersection of said common boundary between Lot 6 and Lot 7, and the west boundary of said tract coveyed to the City of Corpus Christi; Thence S 28° 58' 00" W, along the east boundary of this tract also being the west boundary of said City of Corpus Christi tract, 1320.98 feet, to the point of beginning and containing 61.58 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take e day of ATTEST: ct upon first reading� �as an emergency measure this the.i/J , 190✓ .
