AUTHORIZING THE EXECUTION OF A CONTRACT WITH HUNTER
ASSOCIATES, INC. FOR LOCATION ANALYSIS AND PREPARATION OF
A PERMIT FOR THE SANITARY LANDFILL PROJECT; APPROPRIATING
$55,420 FOR THIS AGREEMENT; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
a contract with Hunter Associates, Inc. for location analysis and preparation
of a permit for the Sanitary Landfill project, a copy of which agreement is
attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated $55,420 from the No.
251 Sanitary Landfill Bond Fund of which appropriation $39,420 is for
engineering fees payable to Hunter Associates, Inc. and $16,000 is for
geotechnical work applicable to Project No. 251-82-1, Sanitary Landfill.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
take immediate action to preserve and protect public property by expediting
the construction of public improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that this
ordinance is passed aplJ shall take effect upon first reading as an emergency

The City of Corpus Christi, hereinafter called "City", and Hunter
Associates, Inc., hereinafter called "Engineer", agree as follows:
I. SERVICES TO BE PERFORMED
The Engineer hereby agrees, at his own expense, to perform all
services necessary to assist the City in the selection of a sanitary landfill
site and prepare the required permits to operate such site as follows.
Phase A - Prepare a development plan for expansion of the City's
present sanitary landfill operation on Greenwood Drive southwest of Saratoga
Boulevard. The plan should include consideration of expansion of the present
site both to the northeast and southwest in addition to any other expansion
recommended by the Engineer. In considering the expansion, factors such as
preliminary soils investigation; drainage; capacity estimates; effect on
City's Master Plans for sanitary sewer, storm sewer, water and streets; the
City's proposed land use plan; airfield hazard elimination plans; AICUZ
studies; length of time a selected site might serve the City; effect on
surrounding properties; and other information pertinent to expansion and a
selected site shall be addressed.
Phase B - After the City has reviewed Phase A recommendations and
agrees to a selected site or sites for expansion purposes, the Engineer shall
prepare an application for permit for such site to the Texas Department of
Health for a municipal solid waste site, to include all facets of such permit
such as detailed soils analysis, groundwater information, public hearings and
related engineering work, all in accordance with current or amended Texas
Department of Health regulations. Prior to submission of proposed boring plan
and preliminary and final permit application to the Texas Department of
Health, these documents shall be submitted to City staff for review and
approval. Engineer shall represent the City in all necessary contact with the
Texas Department of Health including representation at the required public
hearing.

II. SCOPE OF SERVICES
The Engineer agrees to perform, for the above named work, pro-
fessional services as hereinafter set forth:
A. Phase A
1. Hold necessary conferences with the City staff so as to
coordinate the planning of the project.
2. Research available information applicable to the project.
3. Make recommendations for preliminary soil investigation and
secure permission from applicable owners for soil investigation work.
4. Address all pertinent facets of development plan including
but not limited to those shown under Services To Be Performed - Phase A.
5. Submit three (3) sets of development plan studies to the
City Engineer for review by the City.
6. Make any corrections to preliminary development plan as
requested by City.
B. Phase B
1. Prepare, based on City approval of Phase A, a permit
request for the operation of a solid waste site to the Texas Department of
Health. Such request to comply with the guidelines for such permit appli-
cation as published or as might be amended by the Texas Department of Health.
2. Make recommendations for the necessary geotechnical
investigation of the site including obtaining the owner's approval for such
geotechnical work on and/or under owner's property.
3. Represent the City in all necessary contact with the Texas
Department of Health and in all elements of the public hearing process as
requested by the City.
4. Make any and all necessary corrections, additions, or
modifications to the permit request as deemed necessary by both the City and
the Texas Department of Health.
5. Submit copies of said permit request to City as provided
elsewhere herein.
C. Completed Permit and Other Drawings
1. The Engineer shall furnish to the City, upon completion of
said project, or upon termination of this contract as herein provided, three
(3) copies of the permit application and a reproducible set of mylar, or
tracing of all produced drawings, including any and all corrections,

revisions, alterations, or amendments to the permit made during, after or as a
result of the public hearing.
2. The Engineer shall use 24" x 36" sheet sizes of 3 mil mylar
or tracing for the drawings which are to be submitted as described above.
3. The City will not make final payment to the Engineer until
the conditions of Paragraph C are met.
D. Transfer of Interest
The Engineer shall not assign or transfer any interest in this
contract without prior written consent from the City.
E. Orderly Rendering of Services
The Engineer shall furnish the documents required in each phase
of the project and personally render or provide the service required in this
contract in the sequence and times herein indicated and as may be necessary to
insure the prompt and continuous prosecution of the work, and it is understood
that all recommendations and details of site selection and the permit request
are subject to the approval of the City, and until the acceptance of results
of these services, there shall be no liability on the part of the City for
such services. The Engineer agrees to furnish items pertaining to Phase A to
the City within forty-five (45) calendar days of authorization to begin work.
Items required of Phase B will be submitted within one hundred twenty (120)
days of approval of Phase A.
III. COMPENSATION
Fee Schedule - The City agrees to pay the Engineer for his services
for work as outlined herein an amount not to exceed Seven Thousand Six Hundred
Eighty Dollars ($7,680.00) for Phase A services and Thirty One Thousand Seven
Hundred Forty Dollars ($31,740.00) for Phase B services. City will pay
Engineer for Phase A services only after this work is completed and accepted
by the City. The City will pay partial payments for Phase B services with the.
provision that no more than 70% of said Phase B fee will be paid before a
permit to operate a solid waste landfill is granted the City by the Texas
Department of Health. The Phase B fee assumes that Engineer will spend no
more than one (1) day in public hearing involvement in the solid waste permit
process. Should the Engineer spend more than one (1) day in the public
hearing process, additional compensation will be authorized at a rate not to
exceed that paid for the one day. The City will pay all costs for
geotechnical investigation for both phases of work herein outlined.

IV. CITY FURNISHED ITEMS
City will provide topographic maps and aerial photographs of each
site investigated and will make available to Engineer such City documents or
studies to be utilized in site evaluation.
V. CONTRACT TERMINATION
The City reserves the right to terminate this contract at any time
with or without cause. In the event of such termination, the Engineer will be
paid a sum proportionate to the state of completion of the phase of work in
which he is then engaged.
VI. OWNERSHIP OF DOCUMENTS
All drawings, specifications, documents and other materials as
prepared by the Engineer for this project become the sole property of the City
and may be reused, duplicated, etc., all or in part, by the City, and it is
understood that Engineer will not be entitled to any compensation, fee, or
other consideration as a result of City's reuse of these materials.
