CLOSING AND ABANDONING THE 70 FOOT LONG PORTION OF 45
FOOT WIDE WHITELY DRIVE RIGHT-OF-WAY ADJACENT TO LOT 49,
LAGUNA MADRE COVE SUBDIVISION; PROVIDING FOR REPLATTING;
RETAINING THE SUBJECT RIGHT-OF-WAY AS A UTILITY EASEMENT
AND PROVIDING THAT THE OWNER PAY THE COST OF RELOCATING
THE WATER SERVICE TO LOT 49; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 70 foot long portion of 45 foot wide
Whitely Drive right-of-way adjacent to Lot 49, Laguna Madre Cove Subdivision,
as shown by plat recorded in Volume 20, Page 49, Map Records, Nueces County, '
Texas; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said right-of-way,
provided that applicant replat all affected properties and retaining the
subject right-of-way as a utility easement providing that the owner pay the
cost of relocating the water service to Lot 49;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned the 70 foot
long portion of 45 foot wide Whitely Drive right-of-way adjacent to Lot 49
Laguna Madre Cove Subdivision, as shown by plat recorded in Volume 20, Page
49, Map Records, Nueces County, Texas, and more clearly shown by attached
Exhibit "A" and described by metes and bounds below, retaining the subject
right-of-way as a utility easement and providing that the owner pay the cost
of relocating the water service to Lot 49, and provided that applicant replat
all affected properties.
FIELDNOTES for 3,150.00 square feet of right-of-way to be
closed out of Whiteley Drive adjacent to Lot 49, Laguna
Madre Cove, a map of which is recorded in Volume 20, Page
49, Map Records of Nueces County, Texas:
BEGINNING at a 1/2 inch iron pipe found on the Northeast
right-of-way line of Whiteley Drive for the common front
corner of Lots 48 and 49 of said Laguna Madre Cove and
the North corner of this survey;
THENCE South 61° 00' 00" East along said Northeast
right-of-way line of Whiteley Drive, same being the
Southwest boundary line of said Lot 49, 70.00 feet to a
1/2 inch iron pipe found for the East corner of said
Whiteley Drive and an inside corner of said Lot 49 for
the East corner of this survey;
THENCE South 29° 00' 00" West along the Southeast
right-of-way line of said Whiteley Drive, same being the
Northwest boundary line of said Lot 49, 45.00 feet to a
1/2 inch iron pipe found for the South corner of said

THENCE North 61° 00' 00" West, along the Southwest
right-of-way line of Whiteley Drive, 70.00 feet to the
point of intersection with the Southwest extension of the
common lot line of said Lots 48 and 49 for the West
corner of this survey;
THENCE with said Southwest extension, North 29° 00' 00"
East, 45.00 feet to the POINT OF BEGINNING.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid right-of-way, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and
hall take effect upon first reading as an emergency measure this

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
