AN ORDINANCE
AMENDING THE ZONING ORDINANCE UPON APPLICATION OF JACK
RYAN BY GRANTING A SPECIAL COUNCIL PERMIT FOR 250
APARTMENT UNITS ON A PORTION OF LOT 1R, BLOCK 1, NEWPORT
MARINA ESTATES; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Jack Ryan for
amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, July 20,
1983, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit for 250 apartment units
be granted on a portion of Lot 1R, Block 1, Newport Marina Estates, situated
in the City of Corpus Christi, Nueces County, Texas, as shown in the site
plan, a copy of which is attached hereto and made a part hereof, marked
Exhibit "A" and further described by metes and bounds as follows:
FIELDNOTES for 17.33 acres of land out of Lot 1R, Block
1, Newport Marina Estates, a map of which is recorded in
Volume 45, Pages 229 and 230, map records of Nueces
County, Texas:
COMMENCING at a 5/8 inch iron rod set on the North
boundary line of South Padre Island Drive for the
Southeast corner of said Lot 1R, thence North 84° 40' 14"
West, along the North boundary line of South Padre Island
Drive and the South line of said Lot 1R, 9.59 feet to a
concrete marker found for the point of curvature of a
circular curve to the right which has a central angle of
05° 16' 25", a radius of 5649.65 feet, a tangent distance
of 260.18 feet and an arc length of 520.00 feet; thence
with said curve to the right, along the North boundary
line of South Padre Island Drive, 520.00 feet to a point

THENCE continuing in a Westerly direction, along the
North boundary line of South Padre Island Drive and the
South line of said Lot 1R with a circular curve to the
right whose radius point bears North 10° 36' 11" East
5649.65 feet and has a central angle of 08° 47' 21", a
radius of 5649.65 feet, a tangent distance of 434.18
feet, 866.65 feet to a point for the Southwest corner of
this survey;
THENCE North 27° 02' 56" West, along the centerline of
the Reynolds Sales Company 60.00 foot wide pipeline
right-of-way as shown in said Volume 45, Pages 229 and
230, 512.05 feet to a point at the 0.72 foot elevation
line of the Cayo Del Oso for the Northwest corner of this
survey;
THENCE along said 0.72 foot elevation of the Cayo Del
Oso, same being the ownership line between submerged land
belonging to the Public School Fund and private ownership
as approved July 12, 1978 by the General Land Office,
State of Texas, as follows:
North 75° 53' 30" East 11.09 feet;
North 82° 18' 35" East 97.48 feet;
North 74° 23' 30" East 87.05 feet;
North 82° 18' 30" East 95.00 feet;
North 85° 21' 30" East 84.40 feet;
North 82° 17' 00" East 70.82 feet;
North 48° 13' 05" East 83.42 feet;
North 63° 23' 25" East 95.10 feet;
North 72° 08' 05" East 90.88 feet;
North 66° 51' 10" East 81.79 feet;
North 55° 54' 30" East 88.09 feet;
North 75° 59' 35" East 78.20 feet;
North 67° 52' 10" East 87.36 feet;
North 67° 28' 30" East 19.92 feet for the Northeast
corner of this survey;
THENCE leaving the aforementioned 0.72 foot elevation
line, South 31° 19' 15" East 413.39 feet for a corner of
this survey;
THENCE South 05° 19' 46" West 280.16 feet for a corner of
this survey;
THENCE North 84° 40' 14" West 80.00 feet for an inside
corner of this survey;
THENCE South 05° 19' 46" West 392.49 feet to the Point of
Beginning.
In the event the Board of Adjustment grants any special exception
or variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take eff upon first reading as an emergency measure this the c.204--/

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
