HomeMy WebLinkAbout17729 ORD - 07/27/1983AN ORDINANCE CLOSING THE RIGHT-OF-WAY OF HEARN ROAD EAST OF THE FIVE POINTS INTERSECTION SUBJECT TO CERTAIN CONDITIONS; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for hold a hearing concerning the closing of the right-of-way of Hearn Road east of the Five Points Intersection was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and therafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on July 20, 1983, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portion of right-of-way, proposed to be closed, is not needed now, nor will it be within the foreseeable future needed as public right-of-way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That right-of-way of Hearn Road east of the Five Points intersection as described by metes and bounds below and map attached hereto as Exhibit "A" as shown by plat recorded in Volume 27, Page 23, Map Records, Nueces County, Texas, is hereby closed for use as a public right of way, provided that the full width of such right-of-way be retained as a utility easement, that the closed portion of the right-of-way be reverted equally to the abutting owners, and providing for replatting: BEGINNING at a point being the northeast corner of Block A, Brookhaven Annex Subdivision, shown by plat in Volume 27, Page 23, Map Records, Nueces County, Texas, being also a point on the southerly right-of-way of the existing right-of-way of the existing right-of-way of Hearn Road; THENCE N 86° 54' 26" W along said Hearn Road right-of-way 196.26 feet to a point; THENCE N 83° 59' 05" W 2.78 feet to a point; THENCE --N 9° 57' 40" E 60.11 feet to a point; THENCE S 83° 59' 50" E 165.28 feet to a point on a circular curve to the left; 17729 SEI' 28 1984 TSEP 28t 1664 MICROFILMED THENCE in a southeasterly direction along the arc of said curve whose central angle = 65° 57' 54", a radius = 50.00 feet, tangent - 32.45 feet, initial tangent bearing - S 9° 57' 40" W, a distance of 58.21 feet to a point; THENCE s 9° 57' 40" W 4.34 feet to the point of beginning and containing 0.255 acres of land more or less. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by closing and abandoning the aforesaid utility easements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed an shall take effect upon first reading as an emergency measure this the 27 day of July, 1983.
