HomeMy WebLinkAbout17770 ORD - 08/10/1983AN ORDINANCE AMENDING THE MECHANICAL CONTRACTOR LICENSING ORDINANCE TO DELETE PROVISIONS FOR LICENSING BY WRITTEN EXAMINATION; TO EXEMPT HOLDERS OF STATE OF TEXAS AIR CONDITIONING CONTRACTORS LICENSES; AND TO DELAY THE EFFECTIVE DATE UNTIL JUNE 30, 1984. WHEREAS, the City Council passed and approved Ordinance No. 17477 on February 16, 1983, providing for licensing of mechanical contractors effective September 1, 1983; and WHEREAS, the City Council adopted a motion on February 2, 1983, approving the recommendation of the Mechanical Advisory Board that the City support proposed legislation which would establish State licensing of mechanical contractors; and WHEREAS, the Texas Legislature passed and the Governor signed SB 642 relating to the regulation of air conditioning contractors effective September 1, 1983; and WHEREAS, certain amendments are needed to Ordinance No. 17477 in order to avoid duplication and conflict between the City ordinance and the State law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Ordinance No. 17477 passed and approved by the City Council on February 16, 1983, is hereby amended as follows: A. Section 6 is hereby amended by deleting paragraphs (c) through (f) and adding a new paragraph (c){ o read as follows: "(c) The application shall be made on a form prescribed by the examination committee. Each application shall be verified and accompanied by evidence of insurance coverage, a statement of the applicant's practical experience, and any other information necessary to show that the applicant possesses the qualifications required for the license. The applicant is entitled to a mechanical contractor's license if he or she possesses the necessary qualifications, pays the license fee, and has not committed an act which constitutes grounds for denial of a license. Licenses shall be issued in the name of the individual. Upon the death of a person holding a license, any work in progress under a permit previously issued to said licensee may be completed by the firm without further licensing." ,_e 0-i/77SEP 2 81984 SEP 2R'^',4 f4 11 , Og s/�,��1/� , I7770 MICROFILMED B. Sections 7, 8, and 15 are hereby deleted in their entirety. C. Section 12 is hereby amended to hereafter read as follows: "Section 12. Fees. The annual fees for licenses issued or renewed under this ordinance shall be $100 for Class A licenses and $50 for Class B licenses." D. Section 16 is hereby amended by adding a new paragraph (d) to read as follows: "(d) Persons who hold the appropriate air conditioning contractor license issued by the Texas Department of Labor and Standards pursuant to the air conditioning contractor license law of Texas." SECTION 2. Ordinance No. 17477 is hereby further amended by delaying the effective date until June 30, 1984, and said ordinance as amended by this ordinance shall be effective for work done under the terms of mechanical permits issued by the City of Corpus Christi from and after June 30, 1984. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, - word, or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
