HomeMy WebLinkAbout17778 ORD - 08/15/1983AN ORDINANCE CANVASSING RETURNS AND DECLARING THE RESULTS OF THE BOND ELECTION FOR THE PURPOSE OF ACQUIRING AND CONSTRUCTING A NEW CITY HALL AND RELATED PERMANENT IMPROVEMENTS HELD ON THE 13TH DAY OF AUGUST, 1983; AND DECLARING AN EMERGENCY. WHEREAS, on the 13th day of July, 1983, the Mayor and the City Council by Ordinance No. 17709 ordered a bond election to be held on August 13, 1983; and WHEREAS, notice of said election was given as required by law and as directed in said ordinance, as is shown by affidavit properly filed in the office of the City Secretary; and WHEREAS, said election was duly held on the 13th day of August 1983 in conformity with the election laws of the State of Texas, and the results of said election have been certified and returned by the judges and clerks thereof; and WHEREAS, this Council has today canvassed the returns of said election held on the 13th day of August, 1983; and WHEREAS the Council finds' that the said election was in all respects lawfully held and that the City Secretary's tally and certification of results to the Council are correct: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that the City has complied with the Federal Voting Rights Act and Article 1.108 of the Texas Election Code, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election. SECTION 2. That the City Council officially finds and determines that the following votes were cast at said election on the submitted 17778 "SEP 2 81984 MICROFILMED Proposition, by the resident, qualified electors of said City, who voted at said election: 14,432 VOTES: FOR 8,538 VOTES: AGAINST PROPOSITION THE ISSUANCE OF CITY HALL BONDS UP TO ) THE AGGREGATE AMOUNT OF $15,000,000 SECTION 3. That the City Council officially finds, determines and declares the result of said election to be that the proposition so submitted has received a favorable majority vote in all respects and has carried, and that the aforesaid bonds may be issued and taxes may be levied, assessed and collected annually, as voted and approved by law. SECTION 4. The necessity of making an official canvass of votes and declaring the results thereof due to the proceeds from the sale of the proposed bonds being required as soon as possible and without delay for necessary and urgently needed public improvements, creates a public emergency requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency exists, having requested the suspension of the Charter rule that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDING SO ORDAINED, this the W` 1W` day of August, 1983.
