HomeMy WebLinkAbout17779 ORD - 08/15/1983AN ORDINANCE CALLING A RUNOFF ELECTION FOR FOUR (4) COUNCIL MEMBERS IN THE CITY OF CORPUS CHRISTI, TEXAS, TO BE HELD ON THE 27TH DAY OF AUGUST, 1983; DESIGNATING POLLING PLACE LOCATIONS; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance No. 17495 dated March 2, 1983, as approved by U.S. District Judge George P. Kazen, judgment entered June 8, 1983, in Civil Action No. C-81-227, Abel Alonzo et al v. Luther Jones et al, the City Council did ordain that if no candidate for City Council from a given single member district receives a majority of all votes cast for such office at any regular or special election there shall be held on the second Saturday following any such election a run-off election; and WHEREAS, the official canvass of the election returns of the regular election duly held for the office of Mayor and Council Members has been duly had in accordance with State law and City Charter requirements, and inasmuch as none of the candidates for office of Council Member in Districts 1, 2, 4, and 5 received a majority of all votes cast at the said regular election, held on August 13, 1983, for such office, there is hereby declared a necessity for a runoff election. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a runoff election for the election of four (4) Council members, shall be held in the City of Corpus Christi, Texas, on August 27, 1983, with the names of the following candidates to appear on said ballot for the respective offices as follows: District 1 Tucker Fuchs Frank Mendez District 2 District 4 David Berlanga, Sr. Clyde J. That at said election herein ordered all the qualified voters of the City of Corpus Christi in Single Member Districts Nos. 1, 2, 4, and 5 shall be permitted to vote. SECTION 3. That the names of candidates for the office of the City Council Members shall be placed on said ballot in the manner and form prescribed by law. SECTION 4. That voting machines shall be employed at the election herein order in accordance with the provisions of the Revised Civil Statutes of Texas Election Code, Article 7.14, and said election shall be held at the polling places in the regularly prescribed precincts of the City of Corpus Christi, such voting precincts and polling places being as follows: PRECINCT LOCATION 1 Old County Courthouse 1100 Blk. of Mesquite 2 Windsor Park School 4526 S. The polls shall be open from 7:00 a.m. to 7:00 p.m., on the date of the said election. SECTION 5. Bill G. Read, whose office is situated at the Office of the City Secretary, Third Floor, City Hall, 302 South Shoreline Drive, Corpus Christi, Texas, is hereby appointed Election Manager and Judge of said election, and he is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State, and Bill G. Read, is appointed to hold such election in accordance with the laws of this State. SECTION 6. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots shall be used. Absentee voting in person shall be conducted in the lobby of City Hall, the same being designated as the office of the City Secretary, 302 South Shoreline Blvd., Corpus Christi, Texas, from 8:00 a.m. to 5:00 p.m., Monday through Friday, beginning on , August /7 , 1983 and ending o% August oZ3 , 1983. The City Secretary is directed to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 8. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his jurisdiction. SECTION 9. The necessity of ordering a runoff election immediately to meet the requirements of State law and the City Charter creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect its passage, IT IS ACCORDINGLY SO ORDAINED, this the /$'`'8ay of August, 1983.
