HomeMy WebLinkAbout17792 ORD - 08/17/1983AN ORDINANCE ANNEXING A PARCEL OR TRACT OF LAND, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER ARTICLE I, SECTION 2(c), PROVIDING FOR THE ANNEXATION TO THE CITY OF CORPUS CHRISTI OF ROADS, HIGHWAYS, STREETS AND DRAINAGE RIGHTS-OF-WAY ADJACENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI; PROVIDING FOR SEVERABILITY. WHEREAS, on the 6th day of July, 1983, a public hearing was duly held at the Regular meeting of the City Council, following publication of due notice of said hearing in the official newspaper pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of a defined area wholly within the extraterritorial jurisdiction of Corpus Christi, including a portion of the Schanen Ditch,more fully described hereinafter, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed on July 6, 1983; and WHEREAS, it has been determined by the City Council that the territory above mentioned, and now proposed to be annexed, abuts and is contiguous and is adjacent to the City of Corpus Christi and constitutes lands and territories used for public use within the meaning of the City Charter, Article I, Section 2(c); and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid area hereinafter more fully described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby annexed a portion of the Schanen Ditch, more fully described hereinafter by metes and bounds, to -wit: FIELDNOTES for 8.6 acres of land, more or less, out of Lots 2, 3, 4, and 5, Section 11, and Lot 8, Section 19, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas. BEGINNING at a point on the South line of 160.00 foot drainage right-of-way more commonly known as Schanen Ditch, (from which point, the common corner between Lots 2, 3, 4, and 5, Section 11, Bohemian Colony Lands bears North 61° 32' 00" East, 65.00 feet, more or less, thence South 29° 00' 00" East, 660.00 feet, more or less) for a corner of this tract; hilICROFILMED, SEP 2 81984 THENCE in a Southwesterly direction along the South line of Schanen Ditch, and with a curve to the right whose central angle is 16° 17' 31", radius is 367.94, tangent is 52.67, an arc length of 104.62 feet, more or less, to a point for a corner; THENCE South 61° 39' 00" West continuing along said South line of Schanen Ditch, at 39.15 feet, more or less, pass the common line between Lots 2 and 5, Section 11, Bohemian Colony Lands at 675.82 feet, more or less, pass the common line between Lots 4 and 5, Section 11, Bohemian Colony Lands, at 2,229.06 feet, more or less, pass the Northeast line of a 40.00 foot right-of-way, in all, a distance of 2,276.86 feet, more or less, to a point for a corner; THENCE South 61° 39' 00" West continuing with the South line of said Schanen Ditch, a distance of 0.27 feet, more or less, to the point of beginning of a curve to the right whose central angle is 11° 23', a radius is 367.94 feet, tangent is 36.67 feet, and length is 73.10 feet, for a corner; THENCE continuing along the South line of Schanen Ditch, with said curve to the right, an arc distance of 73.10 feet, more or less, to a point for a corner; THENCE South 73° 02' 00" West continuing along said South line of Schanen Ditch, a distance of 35.00 feet, more or less, to a point for a corner; THENCE North 16° 58' 00" West a distance of 500.00 feet, more or less, to a point on a line 20.00 feet from and parallel to the common line between Lot 4, Section 11, and Lot 8, Section 19, Bohemian Colony Lands, for a corner; THENCE South 61° 39' 00" West with said line that is 20 feet from and parallel to the common line between Lot 4, Section 11, and Lot 8, Section 19, a distance of 62.00 feet, more or less, to a point on the North line of aforementioned Schanen Ditch, for a corner; THENCE North 73° 02' 00" East with said North line of Schanen Ditch, a distance of 78.16 feet, more or less, to the point of beginning of a curve to the left whose central angle is 11° 23' 00", radius is 207.94, tangent is 20.72 and length is 41.31, for a corner; THENCE in a Northeasterly direction along said North line of Schanen Ditch and with said curve to the left, an arc distance of 41.31 feet to a point for a corner; THENCE North 61° 39' 00" East continuing with said North line of Schanen Ditch at 1,496.14 feet, more or less, pass the common line between Lots 4 and 5, Section 11, Bohemian Colony Lands, in all a distance of 2,276.59 feet, more or less, to the point of beginning of a curve to the left whose central angle is 02° 14' 38", radius is 207.94, tangent is 4.07 and length is 8.14, for a corner; THENCE continuing along said North line of Schanen Ditch and with said curve to the left, an arc distance of 8.14 feet, more or less, to a point on a line that is 660.00 feet from and parallel to the Southwest and Northeast line of Lot 2, Section 11, Bohemian Colony Lands for a corner; THENCE South 61° 32' 00" East leaving said North line and across Schanen Ditch, a distance of 173.71 feet, more or less, to the POINT OF BEGINNING. The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter, and the ordinances, resolutions, motions and regulations of the City of Corpus Christi, Texas, and the ordinances, resolutions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconsitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. to -t4 �� 1 That the foregoing ordinanc second reading on this the following vote: as read for first tJ'me and p�3&ed to its as of GiLtK , 19Q, , by the Luther Jones Betty N.
