CLOSING AND ABANDONING THE 15 FOOT WIDE DRAINAGE EASEMENT
DEDICATED BY DEED IN VOLUME 1847, PAGE 896, DEED RECORDS,
NUECES COUNTY, TEXAS, AND LOCATED IN LOTS 10 AND 11,
SECTION 5, FLOUR BLUFF AND ENCINAL FARM AND GARDEN
TRACTS, AND THE ADJACENT TEMPORARY CONSTRUCTIONS
EASEMENTS; SUBJECT TO PROVISIONS LISTED BELOW; AND
DECLARING AN EMERGENCY.
WHEREAS, there exists a 15 foot wide drainage easement dedicated by
deed in Volume 1847, Page 896, Deed Records, Nueces County, Texas, and
located in Lots 10 and 11, Section 5, Flour Bluff and Encinal Farm and Garden
Tracts, and the adjacent temporary construction easements dedicated by deed
in Volume 1847, Page 891 and Volume 1847, Page 902; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said easements, subject
to the provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned the 15 foot
wide drainage easement dedicated by deed in Volume 1847, Page 896, Deed
Records, Nueces County, Texas, and located in Lots 10 and 11, Section 5,
Flour Bluff and Encinal Farm and Garden Tracts, and the adjacent temporary
construction easements dedicated by deed in Volume 1847, Page 891 and Volume
1847, Page 902, all as described by metes and bounds in the easements, copies
of which are attached hereto and made a part hereof, marked Exhibits "A",
"B", and "C", providing for rededication on a new alignment.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid drainage easements, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that this
ordinance is passed and shall take effect upon first reading as an emergency
measure this the day of August, 1983.

10, 11, Section 5, Four Bluff and Encinal Farm and Garden Traacts,
a map of which is recorded inVolume .A, Pages 41, 4
records of Nueces County, Texas:
BEGINNING at a point on the Northeast boundary line of said Lot 10
for the East corner of this easement from which corner the East
corner•of said Lot 10 bears South 61°03'37" East 386.85 feet;
THENCE South 28°59'15" West 101.28 feet to a point for a corner of
this easement;
THENCE South 28°40'52" West 234.30 feet to a point for a corner of
this easement;
THENCE South 73°59'10" West 155.61 feet to a point for a corner of
this easement;
THENCE South 79°27'00" West 101.74 feet to a point for a corner of
this easement;
THENCE North 76047'27" West 54.63 feet to a point for a corner of
this easement;
THENCE South 79°27'00" West 201.13 feet to a point for a corner of
this easement;

Together with the free ingress, egress, and regress to and for the City of Corpus
Christi, Texas, for the purpose of construction of a public drainage facility,
and the purpodts of maintaining, servicing, repairing, and inspecting said public
drainage facility under, on, and along said tract.
TO HAVE AND TO HOLD, all and singular, the rights and privileges
aforesaid to the City of Corpus Christi, Texas, its successors and legal repre-
sentatives, for the proper use as a drainage easement and drainage right-of-way,
for so long as used for such purpose, and if the use for said easement and way
of said uses be ever abandoned, then in that event, the aforesaid rights and
privileges shall cease. pp
