HomeMy WebLinkAbout17812 ORD - 08/31/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF TOGAVILLE ACRES, INC. FOR AN EXCEPTION OF THE STANDARD SCREENING FENCE REQUIREMENT ON THE NORTH AND EAST SIDES OF A PORTION OF LOT 7, WOMACK FARM LOTS AND A PORTION OF TRACT 7, W. J. ROBERTSON'S FARM TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Togaville Acres, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, August 31, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That an exception be granted to the standard screening fence requirement along the north and east sides of the hereinafter described tract of land, being described as a portion of Lot 7, Womack Farm Lots, and a portion of Tract 7, W. J. Robertson's Farm Tracts, in the City of Corpus Christi, Nueces County, Texas: Describing a tract of land (being a portion of Lot 7, Womack Farm Lots, and a portion of Tract 7, W. J. Robertson's Farm Tracts, located on the west side of County Road 37 and on the north side of Saratoga Boulevard) by metes and bounds as follows: BEGINNING AT A POINT on the West ROW line of 60 feet wide County Road 37, whence the point of intersection of the centerline of County Road 37 and the centerline of Saratoga Boulevard bears S 61°18'00" E, a distance of 30.00 feet, thence S 29°15'00" W, a distance of 345.00 feet more or less, for the Southeast corner of this tract; SFo 9 8 ioo 17812 MICROFILMED THENCE S 89°26'10" W, a distance of 100.6 feet to a point for a corner; THENCE N 60°45'00" W, a distance of 449.90 feet to a point for a corner; THENCE N 52°38'01" W, a distance of 254.70 feet more or less to a point for a corner; THENCE 528°42'00" W, a distance of 11.00 feet more or less to a point for a corner; THENCE N 44°46'10" E, a distance of 168.00 feet more or less to a point for a corner; THENCE 545°13'50" W, a distance of 125.40 feet to a point for a corner; THENCE N 61°20'08" W, a distance of 195.30 feet to a point for a corner; THENCE N 44049'21" W, a distance of 928.83 feet to a point for the Southwest corner of this tract; THENCE N 23°00'00" E, a distance of 188.60 feet to a point for a corner; THENCE N 61°29'03" E, a distance of 200.00 feet to a point for a corner; THENCE N 58°55'49" E, a distance of 157.00 feet more or less to a point for a corner; THENCED N 55°22'36" E, a distance of 217.90 feet more or less to a point for a corner; THENCE N 51°49'22" E, a distance of 200.00 feet to a point for a corner; THENCE N 45°13'50" E, a distance of 39.50 feet to a point for the Northwest corner of this tract; THENCE S 44°46'10" E, a distance of 1,786.86 feet to a point on said West ROW line of 60 feet wide County Road 37 for the Northeast corner of this tract; THENCE S 29°15'00" W along said West ROW line of County Road 37, a distance of 592.95 feet to the POINT OF BEGINNING, containing 40.00 acres more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take eff ct upon first reading as an emergency measure this the (1./ day of ,19D.�.
