BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1, 2, 3, 4, 5, AND 6 OUT OF LOTS 1, 2, 3, 4, 5, 7, 8, AND 9, SECTION 40, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS FROM "R -1B" ONE -FAMILY DWELLING DISTRICT "B-4" GENERAL BUSINESS DISTRICT AND A-1 APARTMENT HOUSE DISTRICT TO "T -1B" MOBILE HOME PARK DISTRICT ON TRACT 2, "A-1" APARTMENT HOUSE DISTRICT ON TRACT 5, "A-2" APARTMENT HOUSE DISTRICT ON TRACT 6, "R-2" MULTIPLE . DWELLING DISTRICT ON TRACTS 3 AND 4, AND GRANTING A SPECIAL COUNCIL PERMIT FOR A FACILITY THAT WILL BE USED TO CONSTRUCT MODULAR HOMES ON TRACT 1; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Roger Seaman, Jr. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, September 14, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. .That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts of land described as Tracts 1, 2, 3, 4, 5, and 6 out of Lots 1, 2, 3, 4, 5, 7, 8, and 9, Section 40, Flour Bluff and Encinal Farm and Garden Tracts situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District "B-4" General Business District and A-1 Apartment House District to "T -1B" Mobile Home Park District on Tract 2, "A-1" Apartment House District on Tract 5, "A-2" Apartment House District on Tract 6, "R-2" Multiple Dwelling District on Tracts 3 and 4, and a Special Council Permit for a facility used to construct modular homes be granted on Tract 1: SEP 2 81984 17832 MICRursLiviCU Tract 1 FIELDNOTES for 8.97 acres of land, more or less, being all of Green Tree Recreational Vehicle Park Unit 1, a map of which is recorded in Volume 40, Page 160, Map Records of Nueces County, Texas: BEGINNING at a 1 1/2 inch iron pipe found on the Northwest boundary line of Flour Bluff Drive to mark the East corner of said Green Tree Recreational Vehicle Park Unit 1 and the East corner of this tract; THENCE South 28°32'10" West, said Flour Bluff Drive, centerline, 620.00 feet to a the point of curvature of a which has a central angle of feet, a tangent distance of of 15.71 feet; along the Northwest line of 40.00 feet normal to the 3/4 inch iron pipe found for circular curve to the right 90°00'00", a radius of 10.00 10.00 feet and an arc length THENCE with said curve to the right, 15.71 feet for the point of tangency on the Northeast boundary line of Purdue Road. THENCE North 61°27'50" West, along the Northeast boundary line of Purdue Road and the Southwest line of said Green Tree Recreational Vehicle Park Unit 1, 610.00 feet to a point on the Southeast boundary line of said Lot 7, Section 40 for the West corner of Green Tree Recreational Vehicle Park Unit 1 and the West corner of this tract; THENCE North 28°32'10" East, along the Southeast line of said Lot 7, a distance of 630.00 feet to the North corner of said Green Tree Recreational Vehicle Park Unit 1 and the North corner of this tract; THENCE South 61°27'50" East, along the Northeast line of said Green Tree Recreational Vehicle Park Unit 1, 620.78 feet to the POINT OF BEGINNING. Tract 2 FIELDNOTES for 35.03 acres of land, more or less, proposed for T -1B Zoning out of Lots 7 and 8, Section 40, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: BEGINNING at a point for the South corner of this tract from which corner the West corner of Green Tree Recreational Vehicle Park Unit 1, a map of which is recorded in Volume 40, Page 160 of said Map Records bears North 28°32'10" East 30.00 feet; THENCE North 61°27'50" West, along the common boundary line of said Lots 7 and 13 and the common boundary line of Lots 8 and 12, 1250.00 feet, more or less, far the West corner of this Tract; THENCE North 28°32'10" East 1195.00 feet, more or less, to a point on the Southwest line of a 40.00 foot wide railroad right-of-way conveyed to the United States of America by Volume 292, Page 217-218, Deed Records of Nueces County, Texas for the North corner of this tract; THENCE South 63°55'40" East, along the above mentioned Southwest line of the railroad right-of-way, 525.00 feet, more or less, to the point of curvature of a circular curve to the left which has a radius of 1457.50 feet; THENCE with said curve to the left, along said railroad right-of-way, 480.00 feet, more or less, to its intersection with the common boundary line of Lots 4 and 7, Section 40 for a corner of this tract; THENCE South 61°27'30" East, along the common boundary line of said Lot 4 and 7, at 0.72 feet pass a 1 inch iron pipe found on line, in all a distance of 45.83 feet to a 1/2 inch iron rod found for the East corner of this tract; THENCE South 28°32'10" West, at 25.00 feet pass a 1/2 inch iron rod found to mark the North corner of that certain 0.918 acre tract conveyed to the City of Corpus Christi in Volume 1368, Page 398, Deed Records of Nueces County, Texas, at 225.00 feet to a 1/2 inch iron rod found on line for the West corner of said 0.918 acre tract, and an inside corner of this tract; THENCE South 61°27'50" East, along the Southeast boundary line of said 0.918 acre tract, 200.00 feet, more or less, to a corner of this tract; THENCE South 28°26'00" West 435.16 feet, more or less, to the North corner of Greentree Recreational Vehicle Park Unit 1, a map of which is recorded in Volume 40, Page 160 of said Map Records and an angle point of this tract; THENCE South 28°32'10" West 650.00 feet, more or less, to the Point of Beginning. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect r:.e"'ffect upon first reading�as an emergency measure this the CV day of E�) , 19 .
