HomeMy WebLinkAbout17835 ORD - 09/14/1983AN ORDINANCE ANNEXING A PARCEL OR TRACT OF LAND, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER ARTICLE I, SECTION 2(c), PROVIDING FOR THE ANNEXATION TO THE CITY OF CORPUS CHRISTI OF ROADS, HIGHWAYS, STREETS AND DRAINAGE RIGHTS-OF-WAY ADJACENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.. WHEREAS, on the 24th day of August, 1983, a public hearing was duly held at the Regular meeting of the City Council, following publication of due notice of said hearing in the official newspaper pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of a defined area wholly within the extraterritorial jurisdiction of Corpus Christi, including a portion of the Schanen Ditch,more fully described hereinafter, at which all interested persons were afforded an opportunity to'be heard, and by motion duly made, seconded and carried the, said hearing was closed on August 24, 1983; and WHEREAS, it has been determined by the City Council that the territory above mentioned, and now proposed to be annexed, abuts and is contiguous and is adjacent to the City of Corpus Christi and constitutes lands and territories used for public use within the meaning of the City Charter, Article I, Section 2(c); and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid area hereinafter more fully described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby annexed a portion of the drainage right-of-way, more fully described hereinafter by metes and bounds, to -wit: Being a 70.00 foot wide and a 75.00 foot wide drainage easement out of Lots 21, 22, 28, and 29, Section 5, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: BEGINNING at a point on the common boundary line of Lot 4, Section 6 and said Lot 29, Section 5 for the West corner of this easement from which corner the common corner of Lots 3 and 4, Section 6, Lots 29 and 30, Section 5, same being the South corner of Club Estates Unit 3, a map of which is recorded in Volume 44, Pages i'7 835 SEP 2 81984 MICRCHiLMMMEU 25, 26, 27, Map Records of Nueces County, Texas bears North 61°02'50" West 212.47 feet; THENCE South 81°01'35" East 137.81 feet for the point of curvature of a circular curve to the right whose radius point bears South 08°58'25" West 380.72 feet and having a central angle of 19°58'45", a radius of 380.72 feet, a tangent distance of 67.06 feet and an arc length of 132.76 feet; THENCE with said circular curve to the right, 132.76 feet for the point of tangency; THENCE South 61°02'50" East, parallel to the common line of Section 5 and 6 thereof and 70.00 distant therefrom, measured at right angles thereto, 330.71 feet for the point of curvature of a circular curve to the left whose radius point bears North 28°57'10" East 244.39 feet and having a central angle of 46°30'00", a radius of 244.39 feet, a tangent distance of 105.00 feet and an arc length of 198.34 feet; THENCE with said circular curve to the left, 198.34 feet for the point of tangency; THENCE North 72°27'10" East 190.01 feet for the point of curvature of a circular curve' to the left whose radius point bears North 17°32'50" West 217.51 feet and having a central angle of 43°25'10", a radius of 217.51 feet, a tangent distance of 86.60 feet and an arc length of 164.83 feet; THENCE with said circular curve to the left, 164.83 feet for the point of tangency; THENCE North 29°02'00" East 721.38 feet for the point of curvature of a circular curve to the right whose radius paint bears South 60°58'00" East 821.41 feet and having a central angle of 30°00'00", a radius of 821.41 feet, a tangent distance of 220.09 feet and an arc length of 430.09 feet; THENCE with said circular curve to the right, 430.09 feet for the point of tangency; THENCE North 59°02'00" East 596.60 feet for the point of curvature of a circular curve to the left whose radius point bears North 30°58'00" West 373.21 feet and having a central angle of 30°00'00", a radius of 373.21 feet, a tangent distance of 100.00 feet and an arc length of 195.41 feet; THENCE with said circular curve to the left, 195.41 feet for the point of tangency; THENCE North 29°02'00" East 344.05 feet to a point on the Southwest right-of-way line of Whipporwill Drive for the North corner.of this easement; THENCE South 61°00'45" East, parallel to the centerline of said Whipporwill Drive thereof and 30.00 feet distance therefrom, measured at right angles thereto, said centerline being the Northwest boundary line of said Lot 22, Section 5, 75.00 feet for the East corner of this easement; THENCE South 29°02'00" West, leaving said right-of-way line, 464.21 feet for an angle point of this easement; THENCE South 59°02'00" West 716.70 feet for the point of curvature of a circular curve to the left whose radius point bears South 30°58'00" East 746.41 feet and having a central angle of 30°00'00", a radius of 746.41 feet, a tangent distance of 200.00 feet and an arc length of 390.82 feet; THENCE with said circular curve to the left, 390.82 feet for the point of tangency; THENCE South 29°02'00" West 721.38 feet for the point of curvature of a circular curve to the right whose radius point bears North 60°58'00" West 292.51 feet and having a central angle of 43°25'10", a radius of 292.51 feet, a tangent distance of 116.46 feet an arc length of 221.67 feet; THENCE with said circular curve to the right, 221.67 feet for the point of tangency; THENCE South 72°27'10" West 308.35 feet for the point of curvature of a circular curve to the right whose radius point bears North 17°32'50" West 348.81 feet and having a central angle of 02°00'18", a radius of 348.81 feet, a tangent distance of 6.10 feet, and an arc length of 12.21 feet; THENCE with said circular curve to the right, 12.21 feet to a point on said common line of Lot 28, Section 5 and Lot 5, Section 6 for the South corner of this easement; THENCE North 61°02'50" West, along the aforementioned common boundary line 731.99 feet for the POINT OF BEGINNING. The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter, and the ordinances, resolutions, motions and regulations of the City of Corpus Christi, Texas, and the ordinances, resolutions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconsitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient and effective administration of City affairs by annexing the heretofore described drainage easement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the /'day of September, 1983.
