HomeMy WebLinkAbout17841 ORD - 09/21/1983AN ORDINANCE AMENDING CHAPTER 13 OF THE CITY OF CORPUS CHRISTI CODE OF ORDINANCES TO DESCRIBE THE CONDITIONS UNDER WHICH A RECIPROCAL ELECTRICIAN LICENSE MAY BE ISSUED, TO REQUIRE ELECTRICAL CONTRACTOR'S TO HAVE A MASTER ELECTRICIAN WHO IS AN OWNER, OFFICER, OR EMPLOYEE ACTIVELY ENGAGED FULL TIME IN THE CONDUCT OF THE BUSINESS; TO PROVIDE THAT MASTER ELECTRICIANS ARE RESPONSIBLE FOR SUPERVISION OF ALL ELECTRICALLY PERMITTED WORK; TO REQUIRE ANNUAL REGISTRATION OF ELECTRICAL CONTRACTORS; TO ESTABLISH RECIPROCAL LICENSE FILING FEES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That subparagraph (1) of paragraph (b) of Section 13-64 of the Code of Ordinances be amended to read as follows: "(1) The applicant shall show that the applicant has held such license by another city for the twelve (12) months preceding such application for any class of master electrician license with the City of Corpus Christi, or the thirty (30) days preceding such application for a journeyman, limited journeyman, or maintenance electrician license with the City of Corpus Christi; provided, however, that such other city (a) has a licensing ordinance which includes or has substantially adopted the provisions of the most recent National Electrical Code adopted by the National Fire Protection Association, (b) enforces its licensing ordinance, and (c) requires its electrician license applicants to pass a comprehensive written examination satisfactorily demonstrating the applicants' knowledge of the provisions of the National Electrical Code." SECTION 2. That subparagraph (4) of paragraph (b) of Section 13-64 of the Code of Ordinances be amended to read as follows: "(4) Where the licensing ordinance of another city has been examined and the licensing procedure approved by the examination committee, the building official may issue the applicant an electrician 17841 ISEP 28 19 4 LM ED license, provided that such other city permits master, journeyman, limited journeyman, and maintenance electricians licensed in the City of Corpus Christi to obtain electrician licenses under substantially similar conditions and reciprocal licensing procedures required by the City of Corpus Christi. The examination committee shall, during the last quarter of each calendar year, review the electrician license examinations and licensing conditions and procedures of each city for which a current reciprocal license has been issued." SECTION 3. That Section 13-68 of the Code of Ordinances be amended to read as follows: "It shall be unlawful for any person to engage in the business of installing, maintaining, altering or repairing any wiring, fixtures or equipment used for the conducting of electricity for which a permit is required by the electrical code, or for any person or employee of any business in any manner to undertake to execute such work unless such person or employee is the holder of a currently valid license as required herein, except as provided in Section 13-82." SECTION 4. That Section 13-69 of the Code of Ordinances be amended to read as follows: "(a) Every electrical contractor business doing business in the City must have at least one person who holds a current master electrician license and who is one of the following: (1) A sole owner of the business; (2) A full-time paid employee of the business; or (c) Every master electrician must have and maintain an established place of business and shall have a telephone and make the necessary arrangements to receive messages from the electrical inspection section of the City or other persons concerned during regular business hours. The master electrician shall be responsible for the supervision of all electrical work done pursuant to any electrical permits issued to him or his duly authorized agent as described in Section 13-93(e)(1) of the Corpus Christi Electrical Code. Any duly authorized agent shall be a full time employee of said electrical contractor business." SECTION 5. That Section 13-75 of the Code of Ordinances be amended by adding a new paragraph (d) to hereafter read as follows: (d) In addition to the foregoing License Fees, an application for a reciprocal license under the provisions of Section 13-64(b) shall be accompanied by a reciprocal filing fee as follows: Classification (1) Master Electrician, Master Electrician -Sign and Master Electrician - Elevator (2) Journeyman Electrician, Maintenance Electrician and Limited Journeyman Electrician Reciprocal Filing Fee $50.00 20.00 SECTION 6. That paragraph (b) of Section 13-73 be deleted and that paragraphs (c) through (h) be renumbered as paragraphs (b) through (g), respectively. SECTION 7. If for any, reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, clause, phrase, word, or provision of this ordinance, for it is the definite intent P of this City Council that every section, paragraph, subdivision, clause, phrase, word or provisions hereof be given full force and effect for its purpose.
